苔丝悲剧成因的法律批判

【摘要】：本文拟从法律的视角来分析苔丝悲剧的形成原因,认为造成苔丝悲剧的原因不仅是个人性格、资产阶级道德和宗教,更是由那个时代野蛮的、落后的法律造成的。本论文一共分为四章。第一章是绪论,主要介绍法律与文学这个新的研究领域,说明以往研究哈代和《德伯家的苔丝》的方法的不足,介绍本论文的研究思路等情况。其后,本论文分别从实体法、司法过程、程序法三个层面来对苔丝悲剧进行分析。实体法层面主要是揭示影响苔丝命运的财产法、婚姻法、刑法等法律的不公平性,试图勾勒出维多利亚时代社会中主要法律生活和人们享有的权力情况。从司法层面上主要是深入地剖析了苔丝杀人案件中的不公平之处,试图以此为例,使读者能了解到社会中浮在表面上的法律条文,使读者对法律有更深入地了解。最后,在程序法层面上对苔丝杀人案进行分析,主要是通过程序法的分析使读者了解法在实施过程中对人的影响。本文是一个跨学科研究领域的新尝试,试图通过分析使得读者深入理解作品中的事件性质,树正确立人物的形象,把握小说的主题,并能准确了解作者的创作思想。
[Abstract]:This article analyses the cause of the formation of Tess's tragedy from the perspective of law, and thinks that the cause of Tess's tragedy is not only personal character, bourgeois morality and religion, but also caused by the barbarous and backward law of that time.
This thesis is divided into four chapters. The first chapter is the introduction, which mainly introduces the new research field of law and literature, illustrates the shortcomings of the methods of studying Hardy and Tess of the Dharma family in the past, and introduces the research ideas of this paper. Then, this thesis is carried out from three aspects of the substantive law, the law process and the procedural law, respectively. The main aspect of the substantive law is to reveal the unfairness of the law, the law of marriage, the criminal law and other laws affecting the fate of Tess, trying to outline the main legal life and the power of the people in the society of the times of Vitoria. For example, the reader can understand the legal provisions floating on the surface in the society so that the readers can understand the law more deeply. Finally, the analysis of Tess murder case on the level of procedural law is mainly through the analysis of procedural law to make readers understand the influence of the law on the human being in the process of implementation.
This article is a new attempt in the field of interdisciplinary research, trying to make readers understand the nature of the events in the works through the analysis. The tree is establishing the image of the characters, grasping the theme of the novel, and the accurate understanding of the author's creative ideas.
