论我国单身女性生育权的实现

【摘要】：单身女性是在法律上处于非婚姻状态,已经达到一定的年龄,尚未结婚或者打算终身不再结婚的女性。作为一类特殊群体,单身女性放弃了婚姻这种生活方式,但有的单身女性并没有放弃生育的意愿。生育权作为一项基本人权和民事权利中的人格权,单身女性作为主体应该享有,并不因其不结婚而不能生育。单身女性通过合法的人工辅助生殖技术生育一个子女,既是生育权权利属性的要求,也是目前生育率下降、人口老龄化严重的人口问题的现实需要。此外,现代社会中婚姻与生育的分离也为单身女性实现生育权提供了可能。域外相关立法和我国区域立法的先例也提供了实践经验。目前,在我国想要实现单身女性的生育权,在法律、政策和伦理上都存在障碍,实现难度大。但是不能因此忽视单身女性的生育权,应该针对现存的问题,逐步建立完整的单身女性生育权法律体系,加强对人工辅助生殖技术使用的监督管理,完善配套措施,从而使单身女性生育权的实现得到保障。
[Abstract]:A single woman is a woman who is legally not married, has reached a certain age, has not yet married, or intends to never marry again. As a special group, single women give up marriage as a way of life, but some single women do not give up the desire to have children. As a basic human right and a personality right in civil rights, single women should enjoy reproductive rights, not because they do not marry and cannot bear children. It is not only the request of the right attribute of reproductive right, but also the realistic need of the population problem that the fertility rate drops and the aging population is serious, for single woman to have a child through the legal artificial assisted reproductive technology. In addition, the separation of marriage and fertility in modern society also provides the possibility for single women to realize their reproductive rights. The precedents of foreign relevant legislation and our regional legislation also provide practical experience. At present, in order to realize the reproductive rights of single women in our country, there are obstacles in law, policy and ethics, so it is difficult to realize. However, we should not ignore the reproductive rights of single women. We should gradually establish a complete legal system on the reproductive rights of single women, strengthen the supervision and management of the use of artificial assisted reproductive technology, and improve the supporting measures in view of the existing problems. Thus, the realization of single women's reproductive right is guaranteed.
