社会排挤与女性婚姻财产权益的救济

【摘要】：社会排挤(social exclusion)理论,起源于20世纪初期,是对贫困(poverty)、剥夺(dep-rivation)和劣势(disadvan-tagcd)的探讨。随着社会排挤的理论研究与实证研究的深入,中外学者也开始将社会性别分析理论引入社会排挤研究范畴。在社会排挤的背景下,女性财产权益日趋弱化,进而引发女性在婚姻范畴内财产权益的弱化。具体表现是:婚姻时态下家务贡献的贬值;离婚时态下财产权益的流失。为救济女性的婚姻财产权益,必须关注性别平等与公平正义。
[Abstract]:The theory of social exclusion, originated in the early 20th century, is a study of poverty and poverty deprivation (dep-rivation) and disadvantage (disadvan-tagcd). With the deepening of theoretical and empirical research on social exclusion, Chinese and foreign scholars began to introduce the theory of social gender analysis into the category of social exclusion. In the background of social exclusion, women's property rights and interests are weakening, which leads to the weakening of women's property rights and interests in marriage. The concrete performance is: the devaluation of domestic contribution in marriage and the loss of property rights and interests in divorce. In order to help women's marital property rights and interests, we must pay attention to gender equality and fairness and justice.
