离婚纠纷中按揭房屋权属问题研究

【摘要】:房屋乃人之安身立命之本,其使用价值历来为人们所看重。基于安居乐业的传统观念,购置房屋是大多数家庭的头等大事,因此这项不动产在家庭财产中占据着较大比重。目前,由于土地资源稀缺,房产价格不断飙升,在这样的背景下,人们更加看重房屋的价值,由此引发的纠纷也日益增多。在众多的离婚纠纷中,按揭房屋的权属问题是一个热点。但是这一热点目前面临立法的粗疏与理念的冲突,已逐渐成为了困扰司法实践的难题。因此,本文对于涉及按揭房屋在离婚纠纷中处理的法律问题的研究具有重要的现实价值。考虑到约定财产制下按揭房屋的定性和处理相对比较容易,且司法实践中的问题绝大多数发生在法定财产制场合,故本文的探讨仅限于法定财产制的背景下。本文有五章,全面系统地研究了夫妻财产中以按揭方式购买的房屋在离婚时的权属分割问题。第一章绪论,介绍本论文的研究背景及意义,国内外文献综述及研究方法。第二章对房屋按揭制度予以概述。按揭房屋的处理之所以会成为离婚财产分割时的难点所在,最主要是由按揭制度本身的复杂性所决定的,它包括三方主体,四种法律关系,厘清按揭制度下的各种法律关系,是解决按揭房屋权属问题的前提。本章主要介绍了房屋按揭的定义、房屋按揭的法律性质、房屋增值部分的法律性质及对其分割的正当性等相关理论。第三章介绍离婚时按揭房屋权属之争的原因。主要原因有财产法与身份法中财产权属确定规则之间存在冲突;离婚纠纷中按揭权属之争类型化具有多样化;按揭房屋与尚未取得所有权和尚未取得完全所有权房屋概念的混同;婚姻期间个人财产的增值部分如何分割存在争议以及没有明确的法律规定导致各地方判决产生矛盾等。第四章主要针对不同情形下离婚时按揭房屋出现的情况进行类型化分析,将其分为四种情形进行探讨。第五章构建适合我国国情的离婚按揭房屋归属制度。首先对最高人民法院关于适用《中华人民共和国婚姻法》若干问题的解释[三](征求意见稿)第13条进行分析,提出该建议稿存在的问题,如将购房款超过房屋总价款的一半成为判断该房屋为个人财产的核心因素不尽合理,共同还贷部分返还内容不甚清晰等,笔者认为对这一问题的处理应考虑离婚时夫妻财产分割的原则尤其对妇女权益的保护,其次探讨了司法实践中我国按揭房屋在离婚时的具体分割办法,包括按揭房屋被认定为个人财产时,对增值部分处理的问题研究。
[Abstract]:Housing is the basis of people's lives, its use value has always been valued by people. Based on the traditional idea of living and working, buying a house is the top priority of most families, so the real estate occupies a large proportion of the family property. At a time when land is scarce and property prices are soaring, the value of homes has become more valued and disputes are growing. In many divorce disputes, mortgage housing ownership is a hot spot. However, this hot spot is now facing the conflict between legislation and ideas, which has gradually become a difficult problem puzzling judicial practice. Therefore, this paper has important practical value for the study of legal issues concerning mortgage housing in divorce disputes. Considering that it is relatively easy to define and deal with the mortgage house under the contract property system, and the problems in judicial practice mostly occur in the situation of legal property system, the discussion in this paper is limited to the background of legal property system. There are five chapters in this paper, which comprehensively and systematically study the division of ownership in the divorce of the house purchased by mortgage in the property of husband and wife. The first chapter introduces the research background and significance of this paper, literature review and research methods at home and abroad. The second chapter gives an overview of the housing mortgage system. The reason why the processing of mortgage housing becomes the difficulty in the division of divorced property is mainly determined by the complexity of the mortgage system itself. It includes three parties, four kinds of legal relations, and clarifies various legal relationships under the mortgage system. Is to solve the mortgage housing ownership problem premise. This chapter mainly introduces the definition of the housing mortgage, the legal nature of the value-added part of the house and the legitimacy of the division. The third chapter introduces the reason of the dispute about the ownership of mortgage house when divorce. The main reasons are the conflict between the property law and the property right determination rule in the status law, the diversification of the type of mortgage ownership in the divorce dispute. The concept of mortgage house is mixed with the concept of house that has not yet acquired ownership or has not yet acquired full ownership; there are disputes on how to divide the value-added part of personal property during marriage and the lack of clear legal provisions leads to contradictions among local judgments and so on. The fourth chapter mainly analyzes the situation of mortgage house under different circumstances, and divides it into four situations. The fifth chapter constructs the divorce mortgage housing ownership system suitable for our country's national conditions. First of all, the article 13 of the interpretation of the Supreme people's Court concerning the application of the Marriage Law of the people's Republic of China [3] (draft for solicitation of opinions) is analyzed, and the problems existing in the proposal are put forward. If buying more than half of the total house price becomes the core factor in judging the house as personal property, and the contents of the return of the joint repayment of the loan are not very clear, etc. The author thinks that the principle of divorce should be taken into account, especially the protection of women's rights and interests. Secondly, the author discusses the concrete method of dividing the mortgage house in the judicial practice. Including mortgage housing is recognized as personal property, the value-added part of the problem.
