《中华人民共和国反家庭暴力法》人身安全保护令制度评析

【摘要】：《中华人民共和国反家庭暴力法》设立了人身安全保护令制度,我国的人身安全保护令制度与其他国家的人身保护令制度不同,仅指对家庭暴力行为采取行为保全措施的制度,是我国防治家庭暴力的新手段。此次人身安全保护令制度,从制度上对家庭暴力现象进行了严格的规制,有利于从根本上保护受害人,进一步推动我国防治家庭暴力、保护人权的新发展。但是我国现行的人身安全保护令制度规定仍不完善,还存在许多不足,在实践中体现出了一些与我国现实情况脱节的问题,还需要进一步完善。本文通过对《反家暴法》中人身安全保护令制度的评析,结合制度出台一年以来,人身安全保护令制度的实施现状,总结该制度在实践中产生的问题,同时通过借鉴美国民事保护令制度的经验,提出对我国人身安全保护令制度的完善建议。
[Abstract]:The "Law of the people's Republic of China against domestic violence" establishes the system of personal security orders. The system of personal security orders in China is different from that of other countries, and refers only to the system of taking measures to preserve acts of domestic violence. It is a new method to prevent and cure domestic violence in our country. This system of personal security protection has strictly regulated the phenomenon of domestic violence, which is conducive to the fundamental protection of the victims, and further promotes the new development of preventing and controlling domestic violence and protecting human rights in our country. However, the current system of personal security protection in our country is still not perfect, there are still many deficiencies, in practice, there are some problems that are out of touch with the reality of our country, and need to be further improved. Based on the analysis of the system of personal security protection in the Anti-domestic violence Law and the current situation of the implementation of the system since the system was issued one year ago, this paper summarizes the problems arising from the system in practice. At the same time, by drawing lessons from the experience of the civil protection order system in the United States, the author puts forward some suggestions for the perfection of the personal security warrant system in our country.
