【摘要】：宁夏西海固地区回族婚姻习惯法是居住在宁夏西海固地区的回族同胞在长期的生产生活实践中逐步约定俗成、代代相传、不断发展,并在本民族内有较高认可度的关于调整婚姻缔结和解除的规范,其自产生之初就受到伊斯兰文化与我国传统汉文化的双重影响,在广大宁夏西海固地区回族同胞的日常生活中扮演着十分重要的角色。本文在介绍宁夏西海固地区回族婚姻习惯法内容与特点的基础上,重点分析其与我国现行《婚姻法》的关系,总结二者的冲突,如：早婚现象较普遍、结婚程序不合法等,并从切实贯彻法律基本原则、有针对性地加强民族立法与执法、发挥宗教人士的引导作用等方面入手,对冲突进行调适,引导其与我国《婚姻法》相适应。最后探讨关于宁夏西海固地区回族婚姻习惯法的现实意义及未来走向,以期实现其与我国现行《婚姻法》相辅相成的和谐模式,协助解决当地纠纷,有效推进少数民族地区法制建设。
[Abstract]:The marriage custom law of Hui nationality in the Xihaigu area of Ningxia is a kind of law of Hui nationality living in the West Haigu area of Ningxia. It has been gradually established, passed from generation to generation in the long term of production and life practice, and has been constantly developed from generation to generation, and there are high recognition standards on the adjustment of marriage Association and dissolution in this nation. The dual influence of Chinese traditional Chinese culture plays a very important role in the daily life of the Hui compatriots in the West Haigu area of Ningxia. On the basis of introducing the contents and characteristics of the marriage customary law of the Hui nationality in the Xihaigu area of Ningxia, this paper focuses on the analysis of the relationship with the current marriage law in China, and summarizes the conflicts between the two parties, such as the early marriage. It is more common, the marriage procedure is not legal and so on, and from the practical implementation of the basic principles of the law, strengthening the national legislation and law enforcement, giving play to the guiding role of the religious people, adjusting the conflict and guiding it to adapt to the marriage law of our country. Finally, the reality of the marriage custom law of the Hui nationality in Ningxia Xihaigu area is discussed. The significance and future trend will be achieved in order to realize the harmonious mode which is complementary to the current "marriage law" in China, to help solve local disputes and effectively promote the construction of legal system in minority areas.
