妇联介入家庭暴力的路径与优势研究

【摘要】：家庭暴力,特别是妇女家庭暴力问题,已经引起了大众的广泛关注。家庭是社会的重要组成部分,家庭暴力必然会影响社会的稳定,所以说家庭暴力不仅仅是一个家庭问题,同时也是一个社会问题。本研究是针对妇联介入家庭暴力的优势和路径而展开,一方面能够从实证研究的角度丰富我国和家庭暴力相关社会支持理论的研究；另一方面可以帮助遭遇家庭暴力的女性提供维权途径；利用妇联这个平台介入家庭暴力,能够提升政府以及大众对遭受了家庭暴力妇女的关注度；充分体现妇联在反家暴中的作用。本文将理论研究和实践研究相结合,总结了目前国内外部分专家学者对家庭暴力研究的现状,然后阐述了家庭暴力的相关概念,分析了家庭暴力产生的原因、类型及其危害。本研究以社会支持理论为基础,通过对妇联介入家庭暴力的案例分析,总结了妇联介入家庭暴力的过程与途径,分析了妇联介入家庭暴力的优势及困境,提出了妇联介入家庭暴力的政策建议。本研究发现在妇联介入家庭暴力的路径中,不仅运用了自身职能、网络、身份优势来帮助遭受家庭暴力的案主维护自己的权益,而且笔者对妇联介入家暴案例的观察和访谈、以及对案例介入过程和结果的分析,发现妇联介入家庭暴力的主要路径包括妇女信访维权制度的建立和完善、受暴妇女庇护中心的成立、特邀法律援助制度的设立以及家事合议庭的成立,不仅方便妇女上访维权,保护受暴妇女的人身安全,让受暴妇女不惧家暴威胁维护自己的合法权益,同时能够从和谐发展的角度去协调家庭关系,维护社会稳定。同时也发现妇联在介入家庭暴力时出现的一些宏观及微观的问题,包括因司法介入渠道不够畅通、各部门职责不明确、反家庭暴力法制的不健全而使妇联介入家庭暴力陷入困境；又或者从妇联工作人员自身出发,因为介入家暴同时自身安全无法得到保障以及本身职业倦怠的问题而导致妇联自身人员缺乏的困境。通过分析总结,笔者认为妇联应该从自身角度出发改善内部和外部的环境,从加大《反家庭暴力法》的宣传、加强自身维权建设、与多部门合作建立一系列利于《反家庭暴力法》推行,建立更完善社会支持网络的政策措施,以期以后能够发现更多更好地介入家庭暴力的路径。
[Abstract]:Domestic violence, especially the problem of women's domestic violence, has attracted widespread attention. Family is an important part of society, domestic violence will inevitably affect the stability of society, so domestic violence is not only a family problem, but also a social problem. This study is aimed at the advantages and paths of women's federations' intervention in domestic violence. On the one hand, it can enrich the research of social support theory related to domestic violence in China from the perspective of empirical research. On the other hand, it can help women who have suffered domestic violence to protect their rights; using the platform of women's federations to intervene in domestic violence can raise the attention of the government and the public to women who have suffered domestic violence. Fully reflect the role of women's federations in the fight against domestic violence. This paper combines theoretical and practical studies, summarizes the current situation of domestic and foreign experts and scholars on domestic violence, and then expounds the related concepts of domestic violence, analyzes the causes, types and harm of domestic violence. Based on the theory of social support, this study summarizes the process and approaches of women's federations' intervention in domestic violence, and analyzes the advantages and difficulties of women's federations' intervention in domestic violence through the case analysis of women's federations' intervention in domestic violence. Put forward the policy suggestion that the Women's Federation intervene in domestic violence. This study found that in the path of women's federations' intervention in domestic violence, not only the advantages of their own functions, networks and identities were used to help the victims of domestic violence to safeguard their rights and interests, but also the author observed and interviewed the women's federations' intervention in domestic violence cases. As well as the analysis of the case intervention process and results, it is found that the main ways for women's federation to intervene in domestic violence include the establishment and perfection of women's petition system, the establishment of shelters for women victims of violence. The establishment of the specially invited legal aid system and the establishment of the collegial panel on family matters not only facilitate women to petition for their rights, protect the personal safety of women victims of violence, and allow women victims of violence to defend their legitimate rights and interests without fear of domestic violence. At the same time, from the perspective of harmonious development to coordinate family relations, maintain social stability. At the same time, it also found that some macro and micro problems occurred when the Women's Federation intervened in domestic violence, including the lack of smooth channels for judicial intervention and the unclear responsibilities of various departments. The lack of a sound legal system against domestic violence makes women's federations get involved in domestic violence, or start from the women's federations themselves. Women's Federation's lack of staff is caused by its involvement in domestic violence and its lack of security and job burnout. Through the analysis and conclusion, the author thinks that the women's federation should improve the internal and external environment from its own perspective, strengthen the construction of its own rights by increasing the publicity of the Anti-Family violence Law. To establish a series of policies and measures in favor of the implementation of the Anti-domestic violence Law and the establishment of a more perfect social support network in order to find more and better ways to intervene in domestic violence in the future.
