浅析按揭房屋在离婚纠纷中的处理

【摘要】: 随着现代社会的发展和消费观念的转变,按揭购房已经成为普通民众解决住房问题的主流方式,而对于按揭房屋的处理就不可避免地成为了离婚纠纷中的热点。但是这一热点目前面临立法的粗疏与理念的冲突,使得对于按揭房屋在离婚纠纷中的处理已逐渐成为了困扰司法实践的难题。因此,本文对于涉及按揭房屋在离婚纠纷中的处理的法律问题的研究具有重要的现实价值。 因我国现行《婚姻法》实行的是婚后所得共同制的法定财产制和约定财产制相结合的夫妻财产制度,考虑到约定财产制下按揭房屋的定性和处理相对比较容易,且司法实践中的问题绝大多数发生在法定财产制场合,故本文的探讨仅限于法定财产制的背景下。本文除引言、结语外,共有四章,文章较全面系统地研究了夫妻财产中以按揭方式购买的房屋的分割问题。 第一章以一个案例引出离婚纠纷中对按揭房屋的处理所出现的问题。对于按揭房屋在离婚案件中的处理,目前在实践中,存在着大量的司法性指导意见,直接影响到按揭房屋本身以及房屋增值部分的定性和处理,这也正是按揭房屋在离婚纠纷处理中的难点所在,主要包括涉及的法律制度的冲突、按揭房屋的定性与处理、房屋增值部分的定性与处理三个方面。 第二章讨论了房屋按揭涉及的法律关系。按揭房屋的处理之所以会成为离婚财产分割时的难点所在,最主要是由按揭制度本身的复杂性所决定的,厘清按揭制度下的各种法律关系,是解决按揭房屋分割和归属问题的前提。主要介绍了按揭的定义、房屋按揭的法律性质、房屋按揭的物权变动法律关系、房屋增值部分的法律性质四个层面的相关理论。 第三章围绕着按揭房屋在离婚纠纷处理中的几个热点问题,介绍了国内外夫妻财产分割制度中与按揭房屋相关的理论与实践经验。第一节重点关注了英美法系国家有关财产性质转化的理论以及有关个人财产增值的理论;第二节主要就现行相关法律的规定和学术界的观点作了比较分析。 第四章在对前文的理论、观点分析研究的基础上,将离婚案件中的按揭房屋分为已经取得所有权和尚未取得所有权两大类,来探讨适合我国国情的处理方式,以期对我国的司法实践有所裨益。
[Abstract]:With the development of modern society and the change of consumption concept, mortgage purchase has become the mainstream way for ordinary people to solve the housing problem, and the settlement of mortgage housing has inevitably become a hot spot in divorce disputes. However, this hot spot now faces the conflict between legislation and ideas, which makes the settlement of mortgage house in divorce dispute gradually become a difficult problem puzzling judicial practice. Therefore, this paper has important practical value for the study of legal issues concerning the settlement of mortgage housing in divorce disputes. Because the current Marriage Law of our country implements the matrimonial property system which combines the legal property system with the contractual property system, it is relatively easy to define and deal with the mortgage house under the contract property system. Most of the problems in judicial practice occur in the situation of legal property system, so the discussion in this paper is limited to the background of legal property system. In addition to the introduction and conclusion, there are four chapters in this paper. The first chapter introduces the problems of mortgage housing in divorce dispute. At present, there are a large number of judicial guidance opinions on the treatment of mortgage housing in divorce cases, which directly affect the nature and treatment of the mortgage housing itself and the value added part of the housing. This is also the difficult point of mortgage housing in the settlement of divorce disputes, including the conflict of legal system involved, the nature and treatment of mortgage housing, and the qualitative and processing of the value-added part of housing. The second chapter discusses the legal relationship of housing mortgage. The reason why the handling of mortgage housing has become a difficulty in the division of divorced property is mainly determined by the complexity of the mortgage system itself. It clarifies the various legal relationships under the mortgage system. Is to solve the mortgage housing division and ownership of the premise. This paper mainly introduces the definition of mortgage, the legal nature of housing mortgage, the legal relationship of real right change of house mortgage, and the related theory of legal nature of housing value-added part. The third chapter focuses on several hot issues of mortgage housing in the settlement of divorce disputes, and introduces the theoretical and practical experience of the domestic and foreign husband and wife property division system related to mortgage housing. The first section focuses on the theory of property nature transformation and the theory of personal property appreciation in Anglo-American law system countries. The second section mainly makes a comparative analysis on the provisions of current relevant laws and the views of academic circles. The fourth chapter, on the basis of the theory and viewpoint analysis, divides the mortgage house in the divorce case into two categories: the acquired ownership and the unacquired ownership, in order to discuss how to deal with the situation of our country. In order to benefit the judicial practice of our country.
