居住权制度的立法研究

【摘要】：居住权制度自罗马法建立以来，大陆法系各国都纷纷效仿建立了居住权制度以此来实现“居者有其屋”的目标。我国现有的物权法中具备居住权制度所需要的用益物权体系，也存在居住权制度的立法空间，现实生活中住房的紧缺以及经济条件的限制等等都决定了居住权制度设立的必要性和可行性。我国居住权制度起步较晚，所以无论是在法理研究还是在法律制度上都不尽完善，其表现在物权法草案中关于居住权制度的设计上。因此本文在对大陆法系各国关于居住权制度的规定进行论述和归纳居住权制度的发展轨迹上，，对居住权制度的价值理念以及其具体的制度设计进行了探讨，以求进一步完善我国物权法中关于居住权制度的规定。
[Abstract]:Since the establishment of the right of residence system in Rome law, the countries of the continental law system have followed the establishment of the residence right system in order to achieve the goal of "the house has its own house". The limitation of economic conditions and so on determines the necessity and feasibility of the establishment of the residence right system. The system of residence right in China starts late, so it is not perfect both in legal and legal system. It is manifested in the design of the system of residence right in the draft of property law. The article discusses and summarizes the development track of the residence right system, discusses the value concept of the residence right system and its specific system design, in order to further improve the regulations on the right of residence in the property law of our country.
