离婚房屋权属认定及分割问题研究

【摘要】：虽然2011年7月《最高人民法院关于适用中华人民共和国婚姻法若干问题的解释（三）》（以下简称《婚姻法解释（三）》）的出台从某些方面完善了夫妻财产制度，对解决离婚夫妻房产分割问题有很大的指导意义，但其并不能完全解决现实生活中纷繁复杂的各类夫妻财产关系，因此，研究夫妻离婚房屋权属认定及分割仍然十分必要。 本文除了摘要和结语外，总共有三章，，主要是对现实生活及司法实务中争议较多几类房产的出资、所有权形式以及如何分割等方面的探讨。通过梳理现行夫妻财产制下的房屋权属认定的方法、原则，希望可以对几类典型的房产分割进行指导。 本文第一部分阐述了当前我国房屋权属认定及分割的基本理论，分析在现行夫妻财产制下夫妻间的财产归属问题，并比较研究我国婚姻法和物权法中关于夫妻间房屋权属认定问题的规定。简要分析我国离婚案件中房产分割的特点、原则和方法。第二部分主要是对我国现存的几种典型房屋产权归属及分割的问题进行重点细致的分析。第三部分则是在总结前文的基础上，对离婚房屋权属认定和分割问题在制度上提出具体的建议和完善措施。
[Abstract]:Although in July 2011, the Supreme people's Court's interpretation of certain issues concerning the application of the Marriage Law of the people's Republic of China (3) > (hereinafter referred to as the interpretation of the Marriage Law (3) >) perfected the marital property system in some respects. It is of great significance to solve the problem of real estate division of divorced couples, but it can not completely solve the complex real life of all kinds of marital property relations. Therefore, it is still very necessary to study the ownership and division of divorced houses. In addition to the summary and conclusion, there are three chapters in this paper, mainly to the real life and judicial practice in the dispute of several types of real estate investment, ownership forms and how to split the discussion. Through combing the methods and principles of house ownership under the current matrimonial property system, it is hoped that some typical real estate division can be guided. The first part of this paper expounds the basic theory of the confirmation and division of housing ownership in our country, and analyzes the problem of the property ownership between husband and wife under the current matrimonial property system. It also compares the provisions of the Marriage Law and the Real right Law on the ownership of the house between husband and wife. This paper briefly analyzes the characteristics, principles and methods of real estate division in divorce cases in China. The second part mainly analyzes the problems of the ownership and division of several typical houses in our country. In the third part, on the basis of summarizing the above, the author puts forward some specific suggestions and perfect measures on the system of ascertaining and dividing the ownership of divorced housing.
