论夫或妻对夫妻共同债权债务的单方处分权

【摘要】：正 长期以来,我国婚姻立法注重对夫妻财产的静态权属的确认和保护,较少考虑夫妻财产关系的动态变化,忽视对夫妻财产利益流转过程中的调整,致使法院处理夫妻财产关系时缺乏明确具体的法律依据。随着市场经济的发展,夫妻财产关系的动态流转日益增多,虽然婚姻法解释(一)(二)及时出台,对夫妻在婚前和婚姻关系存续期间的债权债务认定作了进一步规定,在一定程度上为统一司法实践尺度、明晰审判思路提供了有利保障,也更利于对善意第三方的权利保护。然而婚姻法及其解释均未对夫妻债权债务的处理予以明确规定,因此对在夫妻关系存续期间
[Abstract]:For a long time, China's marriage legislation has paid attention to the recognition and protection of the static property rights of husband and wife property, less considered the dynamic changes of marital property relations, and ignored the adjustment in the process of transferring the interests of husband and wife property. As a result, courts deal with marital property relations lack of clear and specific legal basis. With the development of the market economy, the dynamic circulation of marital property relations is increasing day by day. Although the interpretation of the Marriage Law (1) (2) was introduced in time, the identification of the creditor's rights and debts of the husband and wife before marriage and during the marriage relationship is further stipulated. To a certain extent, it provides a favorable guarantee for the unification of judicial practice and the clarity of judicial thinking, and is more conducive to the protection of the rights of bona fide third parties. However, neither the Marriage Law nor its interpretation clearly regulates the treatment of the creditor's rights and liabilities of the husband and wife, and therefore during the existence of the relationship between husband and wife.
