我国电信业垄断的法律规制研究

【摘要】：电信业是关系国民经济发展的重要产业,也是为我们生活提供服务的基础性产业,经过几次改革和重组,电信业取得了一定的进步。但是,在取得成绩的同时,垄断问题也层出不穷,这不仅阻碍了电信业的进一步发展,破坏了电信市场良好的竞争秩序,也损害了消费者利益,给我们的生活带来了种种不便。随着4G的发展,5G时代即将来临,有必要破除垄断,引入竞争促进电信行业的发展。本文的脉络体系如下：第一部分导论：以2011年的电信联通反垄断案为例提出问题,分析了选题背景、关于电信业垄断的研究现状以及本文研究的意义,欲通过对电信业规制方案的科学系统梳理,使我国电信垄断问题在实践中得到更好的解决；第二部分：介绍我国电信业的历次改革,主要分析了我国电信业的自然垄断特性及产生原因,并列举了电信业中行政垄断和滥用市场支配地位的行为；第三部分：主要从法律层面和监管机构两方面阐述了我国电信业垄断规制的不足之处,在分析《电信条例》和《反垄断法》在监管电信业方面存在的问题,指出电信监管机构缺乏独立性同时专业性也不强,呼吁电信业的改革进程要进一步加快：第四部分：介绍了美国、英国和日本三国电信业发展的历史,以及电信业监管中的一些特点,并由三个国家电信业改革中的经验对我国电信业的改革提出一些启示；第五部分：结合第三部分分析的我国电信业监管存在的不足,在借鉴美英日三国电信业改革经验的基础上,结合我国的实际情况,提出在电信业基本法、《反垄断法》及电信监管机构三方面进行完善。通过分析,得出完善我国电信业垄断的建议：加快电信业基本法的出台,将“破除垄断、引入竞争”的理念贯彻其中,完备电信监管的法律体系；完善现行的《反垄断法》,注重对消费者权益的保护；尽快设置独立的电信监管机构,保证监管的独立公平公正性。
[Abstract]:Telecommunications industry is an important industry related to the development of the national economy, but also a basic industry to provide services for our life. After several reforms and restructuring, the telecommunications industry has made some progress. However, it has made achievements at the same time. Monopoly problems also emerge in endlessly, which not only hinders the further development of the telecommunications industry, undermines the good competition order of the telecommunications market, but also damages the interests of consumers. With the development of 4G, the 5G era is coming, it is necessary to break the monopoly. Introduction of competition to promote the development of the telecommunications industry. The context of this system as follows: the first part: introduction: taking the 2011 telecom Unicom antitrust case as an example, this paper analyzes the background of the topic. With regard to the status quo of telecom monopoly research and the significance of this paper, we want to solve the problem of telecom monopoly better in practice by combing through the scientific system of the regulation scheme of telecom industry. The second part introduces the previous reforms of China's telecom industry, mainly analyzes the natural monopoly characteristics and causes of China's telecom industry, and lists the behaviors of administrative monopoly and abuse of the dominant position of the market in the telecommunications industry. The third part: mainly from the legal level and the supervision organization two aspects elaborated our country telecommunication industry monopoly regulation insufficiency, in the analysis "telecommunication regulation" and "the anti-monopoly law" in the supervision telecommunication industry aspect question. The paper points out that the telecom regulators lack independence and is not professional, and calls for the reform process of telecom industry to be further accelerated: part 4th: introduces the history of telecom industry development in the United States, Britain and Japan. And some characteristics of the telecom industry supervision, and from the experience of the three countries in the reform of the telecommunications industry to put forward some enlightenment to the reform of China's telecommunications industry; Part 5th: combined with the shortcomings of China's telecom industry supervision analyzed in the third part, on the basis of drawing lessons from the experience of the reform of the telecommunications industry of the United States, Britain and Japan, and combining the actual situation of our country, this paper puts forward the basic law of the telecommunications industry. The Anti-monopoly Law and the telecom regulatory bodies are improved in three aspects. Through analysis, the author puts forward some suggestions for perfecting the monopoly of China's telecommunications industry: speeding up the promulgation of the basic Law of the Telecommunications Industry, and will "break down the monopoly". The concept of "introducing competition" is carried out, and the legal system of telecommunication supervision is completed; Perfecting the current Anti-monopoly Law and paying attention to the protection of consumers' rights and interests; Set up an independent telecom regulatory agency as soon as possible to ensure the independence, fairness and impartiality of supervision.
