电力产业反垄断法适用问题研究——对日本电力自由化改革的考察

【摘要】：电力产业等规制型产业虽然不属于《反垄断法》适用除外领域,但由于规制型产业一般都设立专门的产业规制法和产业监管机构,对规制型产业垄断行为的执法依据及执法机制并不明确。伴随电力市场化改革深化,"竞争促进型"产业政策的出现,使产业政策与竞争政策的关系日益紧密。如何协调两者关系,成为电力产业发展的现实需求。日本主流观点是构建竞争法与产业法两种法律之间的协调、互补关系,并在制度设计和执法实践中探索落实该主流观点。本文在考察1995年至今日本四次电力市场化改革历程及现状的基础上,从学界理论、制度设计、执法实践三个层面归纳日本电力产业中协调竞争法与产业法的主要经验,总结我国电力产业反垄断法执法中可资借鉴之处。
[Abstract]:Although the electricity industry and other regulatory industries do not belong to the anti-monopoly law, but the regulatory industries generally set up special industrial regulation law and industrial regulatory agencies. The law enforcement basis and enforcement mechanism of the regulation industry monopoly behavior is not clear. With the deepening of electricity market reform, the emergence of "competition promotion" industry policy. The relationship between industrial policy and competition policy is becoming more and more close. How to coordinate the relationship between the two becomes the realistic demand of the development of electric power industry. The mainstream view of Japan is to construct the coordination between competition law and industry law. Complementary relationship, and in the system design and law enforcement practice to explore the implementation of this mainstream view. This paper from 1995 to the four electric power market reform in Japan and the current situation of the process based on academic theory. This paper summarizes the main experiences of coordinating competition law and industry law in Japanese electric power industry from three aspects of system design and enforcement practice, and summarizes the points that can be used for reference in the enforcement of power industry anti-monopoly law in China.
