网约车合法化构成对出租车牌照的管制性征收

【摘要】:网约车合法化,本质上是政府放松对出租车的管制,尤其是放松对出租车的进入管制。网约车合法化后,原有出租车经营者的利润遭遇冲击。原有出租车营运牌照是一项牌照持有人支付了对价的特许,体现牌照持有人的财产权,受征收规范保护。网约车合法化克减了原有出租车营运牌照持有人的财产权,破坏了原有出租车投资者基于公平竞争权的合理投资预期,构成对原有出租车营运牌照的管制性征收,应该分门别类补偿原有出租车营运牌照持有人的损失。
[Abstract]:The legalization of netting is essentially a relaxation of the government's regulation of taxis, especially the deregulation of taxi entry. The original taxi operator's profit has been hit. The original taxi operating licence is a licence holder who pays the price, which reflects the property rights of the licence holder. Under the protection of the expropriation norms, the legalization of the net car renouncing reduces the property rights of the original taxi operating licence holders, and undermines the reasonable investment expectations of the original taxi investors based on the right to fair competition. A regulatory levy on the original taxi operating licence should be made up of categories to compensate the loss of the original taxi operating licence holder.
