香港个人破产制度对我国大陆地区的借鉴

【摘要】：随着我国市场经济的快速发展和国际贸易往来的日益频繁,个人破产制度建立与否一直是困扰着中国破产立法的一道难题。在当今市场经济高度发达的国家或者地区都建立了个人破产制度,正是因为有该制度的存在,使得诚实善良的债务人能够免于背负重重债务,得以破产免债,同时能够保证债权的公平受偿。而我国目前尚未建立个人破产制度,这显然与国际社会立法趋势不符。本文分四个部分进行论述,从个人破产制度的概况入手,引出香港地区个人破产制度,并通过层层分析,展现香港破产制度对于当地经济社会所做出的重要贡献。在结合我国现状的基础上提出一些个人的意见和建议,旨在支持个人破产制度的逐步引进。第一部分为个人破产制度的概况。首先对个人破产制度进行背景介绍,然后在此基础上提出个人破产法的含义和立法考量,为全文的展开奠定基础。第二部分为香港个人破产制度概述。这一部分包括介绍香港地区关于个人破产制度的历史渊源,可借鉴性分析,香港个人破产制度的特点、主要参与机构和主要制度,得出香港个人破产制度的意义。由此为下文我国建立个人破产制度提供参考。第三部分为我国大陆地区多年来个人破产制度缺失的原因。主要原因有传统思想的束缚、个人财产登记制度和个人信用制度的不健全、缺乏完善的信贷监督制约机制等。从而引出如何借鉴香港地区的破产立法。第四部分为香港个人破产制度对我国大陆地区的启示。按照上述对香港地区个人破产制度的介绍和分析,结合我国现状,笔者提出了对于未来我国大陆地区构建个人破产制度的几点建议,希望能够加强对各项配套制度的建立和完善,从而为逐步引入个人破产制度保驾护航。
[Abstract]:With the rapid development of China's market economy and the increasing frequency of international trade, Whether the individual bankruptcy system is established or not has always been a difficult problem for China's bankruptcy legislation. In the countries or regions with a highly developed market economy today, the individual bankruptcy system has been established, precisely because of the existence of this system. So that the honest and kind debtor can avoid heavy debts, be able to go bankrupt and avoid debt, and at the same time can guarantee the fair repayment of creditor's rights. However, at present, China has not established a personal bankruptcy system, which is obviously inconsistent with the trend of international legislation. This article is divided into four parts, starting from the general situation of the personal bankruptcy system, it leads to the personal bankruptcy system in Hong Kong, and through layer by layer analysis, This paper shows the important contribution of Hong Kong's bankruptcy system to the local economy and society. Based on the present situation of our country, some personal opinions and suggestions are put forward to support the gradual introduction of the individual bankruptcy system. The first part is the general situation of the personal bankruptcy system. Firstly, the background of the personal bankruptcy system is introduced, and then the meaning and legislative consideration of the personal bankruptcy law are put forward, which lays the foundation for the full text. The second part is an overview of the individual bankruptcy system in Hong Kong. This part includes an introduction to the historical origin of the personal bankruptcy system in Hong Kong, an analysis of its referential nature, the characteristics of the individual bankruptcy system in Hong Kong, the main participating institutions and the main institutions. The significance of the personal bankruptcy system in Hong Kong is obtained, which provides a reference for the establishment of the personal bankruptcy system in China. The third part is the reasons for the absence of personal bankruptcy system in mainland China for many years. The main reasons are the shackles of traditional ideas, the imperfection of personal property registration system and personal credit system. The lack of perfect credit supervision and restriction mechanism leads to how to draw lessons from the bankruptcy legislation in Hong Kong. The 4th part is the enlightenment of the Hong Kong personal bankruptcy system to the mainland of China. According to the above introduction and analysis of the Hong Kong personal bankruptcy system, combined with the current situation of our country, The author puts forward some suggestions on the construction of personal bankruptcy system in the mainland of China in the future, hoping to strengthen the establishment and perfection of various supporting systems so as to guarantee the gradual introduction of individual bankruptcy system.
