我国反垄断法上协同行为的认定

【摘要】：我国《反垄断法》中第13条中规定了“协同行为”,但是相关的实施规则中的相关规定略显单薄,在这样的背景下,本文在讨论协同行为基本理论的基础上,通过概括我国协同行为的现状,发现我国协同行为在实施中存在立法不完善、协同合意难以证明,以及经营者合理理由抗辩等问题。针对这些问题,在探寻了美、欧、俄等反垄断法发展相对完善的国家的相关规定及实践,并结合我国的实际情况后,本文认为应该细化认定协同行为的相关规定,完善协同行为相关的民事、行政甚至刑事责任;改进反垄断执法机构的行政执法权限;注意观察平行行为、调查辅助行为,恰当运用各类间接证据,并结合举证责任倒置及推定制度,组合多种方法证明协同行为的存在。
[Abstract]:"Synergy behavior" is stipulated in Article 13 of our country's Anti-monopoly Law, but the relevant regulations in the relevant implementation rules are slightly weak. Under this background, this paper discusses the basic theory of synergetic behavior. By summarizing the present situation of cooperative behavior in China, it is found that there are some problems in the implementation of synergetic behavior in our country, such as imperfect legislation, difficult to prove synergetic agreement, reasonable defense of operator's reason and so on. In view of these problems, this paper explores the United States, Europe, Europe, and so on. Russia and other countries with relatively perfect development of anti-monopoly law related regulations and practices, and combined with the actual situation in China, this paper believes that we should refine the identification of coordinated acts of relevant provisions, improve coordinated acts related to civil, administrative and even criminal liability; Improve the administrative enforcement authority of antitrust law enforcement agencies; pay attention to observe parallel behavior, investigate auxiliary behavior, properly use all kinds of indirect evidence, and combine with the system of inversion and presumption of burden of proof, combine various methods to prove the existence of synergistic behavior.
