虚假广告法律规制问题研究

【摘要】:广告产业伴随着社会经济发展也在呈现着新的景象,市场经济活动是以追求经济利益为目标,由于虚假广告可以给经济主体带来利润最大化,这样就给虚假广告带来生存契机,以各种名目、各种形式应运而生。虚假广告以误导宣传为手段,尤其在部分热门行业,干扰消费者的正常判断,以错误的信息来蒙骗大众,使得消费者的合法权益遭受损失,经济秩序受到破坏,极大地损害了市场经济的发展,并由此造成市场经济秩序极度混乱,为此要对虚假广告进行严厉打击和遏制。虚假广告日益泛滥,对虚假广告进行有效的法律规制,遏制虚假广告违法行为,净化市场竞争环境,为消费者的合理权益提供有力的保障,增加市场竞争的透明度。为更好地保护消费者权益,维持和谐市场经济秩序,将对虚假广告的规制问题进行深入研究。经济社会中,虚假广告以多种名义欺骗消费者,实现为自己谋取不法利益目的,对社会正常运转带来极大的危害。此文章基于我国虚假广告对市场经济的危害,展开论述,共分为六章,第一章,绪论,主要介绍虚假广告产生的背景和研究该问题的意义;第二章,广告的基本理论,内容包括广告和虚假广告的概念、特征和性质,从而对虚假广告的涵义有整体把握,是后文研究的基础。第三章,我国虚假广告的现状及法律规制存在的问题,主要分析我国虚假广告现在所呈现的特点,以及立法规制、政府监管机制和行业自律机制中存在的问题。第四章,域外规制虚假广告的相关法律的制度规定及对我国的借鉴,对比域外英国和美国的相关规定,结合我国实际情况,为完善我国虚假广告的法律规制提供可借鉴的经验。第五章,完善我国对虚假广告法律规制建议,主要针对第三章中阐述的主要问题,借鉴域外成功之处,从三个方面具体提出了治理虚假广告法律规制的建议,从立法、政府监管和行业自律入手进行针对性的建议解决。第六章,结论。通过对虚假广告现状及原因分析,阐述规制虚假广告的立法建议,希望为虚假广告早日消灭尽微薄之力。
[Abstract]:Along with the development of social economy, advertising industry is also presenting a new scene. Market economy activities aim at pursuing economic benefits, because false advertising can bring profit maximization to the economic subject, so it will bring the chance of existence to the false advertisement. False advertising, especially in some popular industries, interferes with consumers' normal judgment, deceives the public with wrong information, and causes consumers' legitimate rights and interests to suffer losses. The economic order has been destroyed, which has greatly damaged the development of the market economy, and has caused extreme chaos in the market economy order. Therefore, it is necessary to severely crack down on and contain false advertisements. In order to protect the rights and interests of consumers, it is necessary to regulate the false advertisements effectively, curb the illegal activities of false advertisements, purify the market competitive environment, provide effective protection for the reasonable rights and interests of consumers, and increase the transparency of market competition. To maintain a harmonious market economic order, the regulation of false advertising will be deeply studied. In economic society, false advertisements deceive consumers in various names and achieve the purpose of seeking illegal interests for themselves. This article is based on the harm of false advertising to the market economy in China. It is divided into six chapters: the first chapter, the introduction, mainly introduces the background of false advertising and the significance of studying the problem; The second chapter, the basic theory of advertising, includes the concept, characteristics and nature of advertising and false advertising, so as to grasp the meaning of false advertising as a whole, which is the basis of the later study. The present situation of false advertising in China and the problems existing in legal regulation are mainly analyzed. The characteristics of false advertising in China are analyzed, as well as the problems in legislation regulation, government supervision mechanism and industry self-discipline mechanism. Chapter 4th, The system and regulations of the extraterritorial regulation of false advertising and its reference to our country, contrasting the relevant provisions of the United Kingdom and the United States, and combining the actual situation of our country, to provide the experience for reference for perfecting the legal regulation of false advertising in China. Chapter 5th, In order to improve the legal regulation of false advertising in China, aiming at the main problems described in Chapter 3, the author puts forward some suggestions on how to regulate the legal regulation of false advertising from three aspects, using the success of foreign countries for reference, and puts forward some suggestions on how to regulate the legal regulation of false advertising from three aspects. Chapter 6th, conclusion. Through the analysis of the present situation and reason of false advertisement, this paper expounds the legislative suggestion of regulating false advertisement, hoping to do a little for the elimination of false advertisement as soon as possible.
