【摘要】：随着市场经济不断发展,质量技术监督越来越受到广大人民群众的关注。它不仅关系着国计民生,而且还关系着社会发展和国家形象。一个国家的产品质量水准是衡量其经济发展水平和文明程度高低的重要指标之一。倘若市场充斥着假冒伪劣商品,不法商贩肆意横行,那么“劣币驱逐良币”,市场将无法健康运转。国家机构的调整和社会需求的增多,使得质量技术监督的重要性愈加明显。通过不懈努力,我国质监方面工作取得了可喜的成绩。然而,在质监行政执法过程中,我们依旧能够发现许多问题。本文以郑州市质监局为视角,将质监行政执法主体作为考量对象,力求通过实证性分析,找出质监行政执法困境所在,并为提升质监行政执法水平提出一些建议。质量技术监督系统改革不仅是建立“服务型”政府、实现依法行政,降低执法纠纷的客观要求,也是改变各级质监行政执法工作质量、工作态度,更好地为广大人民群众服务的迫切要求。本文一共分为四章。第一章,主要阐释质量技术监督的基本理论。分别从质监的职责范围,质监的合法性依据,质监权的约束机制、质监的依法行政途径四个方面来考量。第二章以郑州市质监局为视角,分别从质监行政执法主体、依据、权责范围、执法途径四个方面进行考察。以“街头官僚”理论为基础,发现质监行政执法过程中所存在的问题。第三章主要针对上述问题,有针对性的进行剖析。找出造成质监行政执法困境的四方面原因,分别是:执法意识存在偏差,执法资源薄弱、执法机制运行不畅、执法监督不力等。第四章是基于前面章节的阐释、论证、剖析,就质监行政执法难的问题展开论述,找出解决困境的出路。第一,要从“法的精神”入手,法治与德治并行,刚柔并济,大力弘扬质监行政执法精神。第二,要优化执法资源,使人尽其才,物尽其用。第三,大胆创新,对质监行政执法体制进行改革。第四,以监督为抓手,始终不松懈对执法主体的监管,保证质监行政执法的公平、公正、公开。
[Abstract]:With the development of market economy, the quality and technical supervision is becoming more and more people's attention. It is not only related to the beneficial to the people's livelihood, but also related to the social development and national image. The product quality standard of a country is one of the important indicators to measure the level of economic development and a high degree of civilization low. If the market is flooded with fake and shoddy goods illegal traders, wantonly, so "bad money drives out good money, the market will not increase. The healthy operation of national institutions and the adjustment of social needs, the importance of quality and technical supervision more obvious. Through unremitting efforts, China's quality supervision work has made gratifying achievements. However, in the process of administrative law enforcement supervision in, we can still find a lot of problems. This paper takes the Zhengzhou Municipal Quality Supervision Bureau of quality supervision from the perspective of the administrative law enforcement main body as the measure object, through empirical analysis, Find out where the quality supervision of administrative law enforcement difficulties, and puts forward some suggestions for improving the quality supervision of administrative law enforcement reform. The level of quality and technical supervision system is not only the establishment of service-oriented government administration according to law, reduce the objective requirements of law enforcement disputes, but also to change at all levels of quality supervision of administrative law enforcement work quality, work attitude and demands better service for the broad masses of the people. This paper is divided into four chapters. The first chapter mainly explains the basic theory of quality and technical supervision. From the scope of quality supervision duties, legal basis of quality supervision, quality supervision and restraint mechanism of the right quality supervision administration way four aspects to consider. The second chapter in Zhengzhou city from the perspective of Quality Supervision Bureau of quality supervision, respectively from the administrative law enforcement main body, based on the scope of responsibility, investigates four aspects of law enforcement. Second, to optimize the resources of law enforcement, make their best use. Third, bold and innovative the quality supervision and administrative law enforcement system reform. In fourth, supervision as the starting point, always don't let up on the subject of law enforcement supervision, to ensure the quality supervision of administrative law enforcement, fairness, justice, open.
