我国综合运输法律改革与完善研究

【摘要】:本文先分析我国构建综合运输法律的概念、发展状况以及对我国综合运输的意义,后分别从纵向和横向两个角度分析我国综合运输法律的改革与完善,前者从公路、铁路、水运和航空四个方面展开论述,后者以《鹿特丹规则》为例展开对我国综合运输民事立法的完善建议。最后,结合前文的公法和私法两方面的阐述,提出构建我国综合运输法律的立法构想。本篇论文除引言和结论外,共包含四部分:第一章:综合运输法律概述,介绍了综合运输法律概念和特征、综合运输法律与物流法和多式联运法律的区别,并提出我国构建综合运输法律的意义和迫切需要。第二章:展开介绍我国综合运输管理法律和民事法律的发展现状。对公路、铁路、航空和水运四种运输方式的国内立法进行分析。第三章:参考外国综合运输法律的发展历程和制定方法。先介绍美国、日本和德国的综合运输管理法律,后以《荷兰民法典》和《德国商法典》为例介绍发达国家的综合运输民事法律。因现阶段综合运输民事方面法律发展不成熟的社会现状,而《鹿特丹规则》又首次大胆尝试将“海上+其他”的运输方式共同调整的创新,对《鹿特丹规则》的发展模式进行介绍。第四章:借鉴国外经验和我国发展现状,在完善单一运输方式的法律的基础上,根据我国国情制定适合我国的综合运输法律,分别对管理法律和民事法律的衔接部分加以调整,使综合运输立法更好地起到促进综合运输发展的需求。
[Abstract]:This paper first analyzes the concept, development and significance of the construction of integrated transport law in China, and then analyzes the reform and perfection of the comprehensive transport law in China from the vertical and horizontal angles, the former from the highway and the railway. Water transportation and aviation are discussed in four aspects. The latter takes Rotterdam rules as an example to put forward some suggestions on the improvement of China's comprehensive transport civil legislation. Finally, combining the above two aspects of public and private law, In addition to the introduction and conclusion, this paper consists of four parts: chapter one: an overview of integrated transport law, introducing the concept and characteristics of integrated transport law. The difference between the integrated transport law and the logistics law and the multimodal transport law, and the significance and urgent need of constructing the integrated transport law in our country are put forward. Chapter two: the development status of the comprehensive transport management law and the civil law in our country is introduced. Analysis of domestic legislation on four modes of transport: railway, air and water transport. Chapter three: referring to the development and formulation of foreign integrated transport laws. First introduce the integrated transport management laws of the United States, Japan and Germany. Then take the Dutch Civil Code and the German Commercial Code as examples to introduce the comprehensive transport civil law in developed countries. The Rotterdam rules are the first bold attempt to bring forth the innovation of "other modes of transport at sea" and introduce the development model of the "Rotterdam rules". Chapter 4th: drawing lessons from foreign experience and the present situation of development in China, On the basis of perfecting the law of single mode of transport, and according to the national conditions of our country, to formulate comprehensive transport law suitable for our country, and to adjust the linking part of management law and civil law respectively. So that the integrated transport legislation better play to promote the development of integrated transport needs.
