【摘要】：邮轮旅游业在我国悄然兴起,我国越来越多的人被邮轮旅游这种新兴的旅游模式所吸引,参与到此种活动中,然而频发的邮轮旅游群体性事件表明,我国的邮轮旅客权利没有得到有效的保护,这使很多对邮轮旅游感兴趣的旅客望而却步,限制了我国邮轮旅游业的发展。故我国应该加强对邮轮旅客权利保护的研究进程,以期能够为邮轮旅客提供更好的旅行体验,同时希望我国能够从各个方面建立邮轮旅客权利保护的配套制度,从根本上解决邮轮旅客权利保护问题。第1章“邮轮旅客权利保护研究概述”首先介绍了邮轮和邮轮旅游的相关知识。然后根据国邮轮旅游发展现状,总结了邮轮我国邮轮旅客权利保护中出现的问题：邮轮公司和旅行社权责不明、邮轮旅客权利保护水平不高、相关配套制度、法律法规不完善。最后分析了邮轮旅客保护的必要性指出本文研究意义。第2章“邮轮公司和旅行社的责任”分析了邮轮公司、旅行社在我国现行邮轮旅游模式下的法律定位,邮轮公司、旅行社各自对邮轮旅客负有哪些义务以及在邮轮旅客权利受到侵害时承担什么样的责任,解决邮轮旅客权利保护权责不明的问题。第3章“邮轮旅客权利保护存在的问题”,指出了邮轮旅客缔约能力弱,分析了邮轮旅客在维权过程中发生的维权困难、不合理维权方式的原因,提出解决方案。通过对欧盟《海上旅客权利条例》的介绍提出要保护特殊邮轮旅客的权利,以期对不同类型的邮轮旅客的权利提供全面的保护。第4章“我国保护邮轮旅客权利的配套法律制度”,提出进行邮轮安全立法、建立邮轮旅游格式合同、健全多元化的邮轮旅游纠纷解决机制,完善邮轮旅游保险四个层面弥补邮轮旅客权利保护的法律和配套政策的空白。
[Abstract]:Cruise tourism is rising quietly in our country. More and more people in our country are attracted by cruise tourism, which is a new tourism mode, and participate in this kind of activities. However, the frequent group events of cruise tourism show that, The rights of cruise passengers in China have not been effectively protected, which has deterred many passengers interested in cruise tourism and restricted the development of cruise tourism in China. Therefore, our country should strengthen the research process of the protection of the rights of cruise passengers. With a view to providing a better travel experience for cruise passengers, we hope that our country can establish a supporting system for the protection of the rights of cruise passengers in all aspects. Chapter 1, "Overview of the study on the Protection of the Rights of Cruise passengers", first introduces the relevant knowledge of cruise and cruise tourism, and then according to the current situation of cruise tourism in China, The problems in the protection of cruise passengers' rights in China are summarized: the rights and responsibilities of cruise companies and travel agencies are not clear, the level of protection of cruise passengers' rights is not high, and the relevant supporting systems, Finally, the necessity of the protection of cruise passengers is analyzed and the significance of this study is pointed out. Chapter 2, "liability of cruise companies and travel agencies", analyzes the legal position of cruise companies and travel agencies under the current cruise tourism mode in China. What obligations do cruise companies and travel agencies each have to cruise passengers and what kind of responsibilities they bear when the rights of cruise passengers are infringed, Chapter 3, "problems existing in the protection of the rights of cruise passengers", points out that the contracting capacity of cruise passengers is weak, and analyzes the difficulties in safeguarding the rights of cruise passengers in the process of safeguarding their rights. Through the introduction of the EU regulations on Maritime passenger Rights, it is proposed to protect the rights of special cruise passengers. In order to provide comprehensive protection to the rights of different types of cruise passengers. Chapter 4, "China's supporting legal system for the protection of the rights of cruise passengers", puts forward legislation on cruise safety, establishes a contract for the form of cruise tourism, Perfect the diversified dispute resolution mechanism of cruise tourism and perfect the four levels of cruise tourism insurance to make up the gaps in the laws and supporting policies for the protection of the rights of cruise passengers.
