我国自然垄断行业的法律规制研究

【摘要】：我国大多数行业在逐步深入的经济体制改革过程中已经渐渐摆脱垄断状态,取而代之的是一种自由竞争的状态,政府主要以市场化的方式实现行业管理的目的,对于市场主体竞争行为的规范主要依据竞争法。但是有些行业在特殊自然条件及供需关系的影响下,并不能顺利的适应市场竞争机制,这就是本文所讲的自然垄断行业。可以说自然垄断行业与我们的日常生活息息相关,在公共产品和公共服务的提供方面承担着不可替代的重要职能,对我国经济安全、稳定的发展意义重大,但是就目前的情况来说,不管是此类行业本身抑或是对其法律规制方面都存在着一些问题。除此之外,作为消费者的我们与这些提供公共产品与公共服务的生产者、经营者相比,处于绝对的劣势地位,不能完全自由地依据自己喜好对商品、服务及经营者做出选择。基于以上考虑进行了论文的写作。本文主要分为四个部分:第一部分介绍自然垄断的基础理论及为何要对其进行规制,在介绍自然垄断的定义、特征、成因等理论的基础之上,具体分析了为什么要对自然垄断行业进行进行规制。第二部分从对我国自然垄断行业进行法律规制必要性入手,着重分析此类行业规制的现状,主要包括相关法律规定存在的缺陷、法律责任弱化及竞争机构与监管机构设置不具体三方面。第三部分介绍了美国及欧盟对自然垄断行业的法律规制经验,试图在厘清我国此类断行业存在诸多问题的基础上,通过比较分析的方法,借鉴西方发达国家自然垄断行业法律规制的实践明。第四部分综合考虑我国自然垄断行业法律规制存在的问题,借鉴国外相关的经验与实践,提出完善我国自然垄断行业法律规制的建议。包括完善立法、合理配置规制机构及其权力分配、完善价格规制措施及引入反垄断公益诉讼制度。
[Abstract]:In the process of deepening economic system reform, most industries in our country have gradually got rid of the monopoly state and replaced by a state of free competition. The government mainly realizes the purpose of industry management by means of marketization. The regulation of competition behavior of market participants is mainly based on competition law. However, under the influence of special natural conditions and supply and demand relations, some industries are not able to adapt to the market competition mechanism smoothly. This is the natural monopoly industry mentioned in this paper. It can be said that the natural monopoly industry is closely related to our daily life and plays an irreplaceable important role in the provision of public goods and public services, which is of great importance to the economic security of our country. Steady development is of great significance, but there are some problems in the current situation, both in the industry itself and in its legal regulation. As consumers, we are at an absolute disadvantage compared to the producers and operators who provide public goods and services, and we are not completely free to base our preferences on goods. This paper is divided into four parts: the first part introduces the basic theory of natural monopoly and why it should be regulated, and introduces the definition and characteristics of natural monopoly. On the basis of the theory of cause of formation and so on, the author concretely analyzes why the natural monopoly industry should be regulated. The second part starts with the necessity of legal regulation of our country's natural monopoly industry, and emphatically analyzes the present situation of the regulation of this kind of industry. The third part introduces the legal regulation experience of the United States and the European Union in the natural monopoly industry, including the defects of the relevant laws and regulations, the weakening of legal liability and the non-specific establishment of competition agencies and regulatory bodies, the third part introduces the experience of the United States and the European Union in regulating natural monopoly industries. On the basis of clarifying the problems existing in such broken industries in China, this paper attempts to make a comparative analysis of these problems. Drawing lessons from the practice of the legal regulation of natural monopoly industry in western developed countries. 4th, considering the problems existing in the legal regulation of natural monopoly industry in our country, and drawing lessons from the relevant experience and practice of foreign countries. Some suggestions are put forward to perfect the legal regulation of the natural monopoly industry in China, including perfecting the legislation, rationally allocating the regulatory bodies and their power distribution, perfecting the price regulation measures and introducing the antitrust public interest litigation system.
