我国政府采购主体信息披露义务研究

【摘要】:政府采购是政府部门运用财政支出购置公共用品的行为,同时它又作为国家调控宏观经济的重要手段,通过政府对公共产品购买方向的选择和购买量的调整,对经济活动进行调节,来弥补市场失灵所带来的缺陷。伴随着政府采购活动规模的不断扩大,采购数量的日益攀升,政府采购对经济发展的作用和影响也越来越被人们所认识。然而,政府采购主体信息披露又是政府采购中的重要和关键环节,它的规范程度直接决定了整个政府采购过程的公开、公平与公正原则的落实情况。《中华人民共和国政府采购法》(以下简称《政府采购法》)、《中华人民共和国招标投标法》(以下简称(《招标投标法》)虽已出台多年,但通过分析比较可以看出,我国现行法律法规存在诸多矛盾与冲突。在实践中,很多问题不能得到有效解决。基于政府采购信息披露中存在的问题,本文分析产生主体披露问题的原因,在结合我国国情的基础上,借鉴和吸收国际上先进的经验,提出有关采购主体、采购信息内容、渠道、方式等具体的完善建议,有力的推进政府采购事业健康和谐的发展。 第一章分析建立政府采购主体信息披露义务制度的必要性。本章在界定政府采购主体范围的基础上,分析采购人和采购代理机构信息披露义务。并进一步提出采购主体信息披露义务的必要性,这无疑是贯彻与落实《政府采购法》公开、公平、透明原则的重要保障。最后,阐述政府采购主体信息披露义务的理论基础,即提高财政资金使用效率,节约社会成本理论,保护弱势群体,维护信息的对称性理论。 第二章分析我国政府采购信息披露义务现状及问题。本章开篇列举国家大型工程项目—“萧山大陆饮水工程项目”在招投标中严重造假,长沙工商局违法采购等案例。之后,从我国立法位阶的角度指出我国政府采购信息披露义务的现状。进一步分析我国政府采购信息公开在实践中存在的主要问题,即从政府采购主体的范围、信息披露渠道、披露的公开方式与内容、监管制度与法律责任等方面探讨了采购主体信息披露存在的问题并指出产生问题的原因。 第三章是完善我国政府采购主体信息披露义务体系。对于采购主体信息披露体系的完善,本文主要从宏观方面进行把握。在结合《政府采购协议》、《采购示范法》等国际上先进经验的基础之上,采取比较分析的方法,提出完善包括采购主体的范围、披露途径、披露内容和法律责任四方面的建议。具体而言,应该逐步扩大采购主体的范围,以适应社会发展的需求;统一披露的途径、内容和方式以保护供应商和相关主体的权益,明确法律责任,做到有法可依,对违法者应加大惩处力度,以保证法律的权威。
[Abstract]:Government procurement is the behavior of government departments to use fiscal expenditure to purchase public goods. At the same time, as an important means for the state to regulate and control the macro economy, the government adopts the choice of purchasing direction and the adjustment of purchase amount of public goods. Adjust the economic activities to make up for the defects caused by the market failure. With the continuous expansion of the scale of government procurement activities, the number of procurement is rising day by day. The role and influence of government procurement on economic development is also more and more recognized. However, the disclosure of government procurement information is an important and key link in government procurement. Its degree of regulation directly determines the openness of the whole government procurement process. Implementation of the principle of Fairness and Justice. Although the Law on Government Procurement of the people's Republic of China (hereinafter referred to as the Law on Government Procurement) and the Law of the people's Republic of China on bidding and bidding (hereinafter referred to as "the Law on tendering and bidding") have been promulgated for many years, But through the analysis and comparison, we can see that there are many contradictions and conflicts in the current laws and regulations of our country. In practice, many problems can not be solved effectively. This paper analyzes the causes of the disclosure problem of the subject, draws lessons from and absorbs the international advanced experience on the basis of the national conditions of our country, and puts forward some concrete suggestions on how to improve the procurement subject, the content of the procurement information, the channels, the way, and so on. To promote the healthy and harmonious development of government procurement. The first chapter analyzes the necessity of establishing the system of information disclosure obligation of government procurement subject. This chapter defines the scope of government procurement subject on the basis of this chapter. This paper analyzes the obligation of information disclosure of the purchaser and the procurement agency, and further puts forward the necessity of the obligation of information disclosure of the purchasing body, which is undoubtedly an important guarantee for the implementation and implementation of the principles of openness, fairness and transparency of the "Government Procurement Law". Finally, This paper expounds the theoretical basis of the obligation to disclose information of the government procurement subject, that is, to improve the efficiency of the use of financial funds, to save the social cost, to protect the vulnerable groups, and to maintain the theory of information symmetry. The second chapter analyzes the current situation and problems of information disclosure obligations of government procurement in China. At the beginning of this chapter, it enumerates the cases of "Xiaoshan mainland drinking Water Project", such as serious fraud in bidding, illegal procurement by Changsha Bureau of Industry and Commerce, and so on. This paper points out the present situation of our government procurement information disclosure obligation from the angle of our country's legislative rank, and further analyzes the main problems existing in the practice of our country's government procurement information disclosure, that is, the scope of the government procurement subject and the information disclosure channel. This paper probes into the problems existing in the disclosure of information of the purchasing body from the aspects of the disclosure mode and content, the supervision system and the legal responsibility, and points out the reasons for the problems. The third chapter is to perfect the obligation system of information disclosure of government procurement subject in our country. Based on the advanced international experience, such as the Agreement on Government Procurement and the Model Law on Procurement, this paper takes the method of comparative analysis and puts forward the improvement of the scope of the procurement subject and the way of disclosure. In particular, the scope of the purchasing body should be gradually expanded to meet the needs of social development; the ways, contents and methods of unified disclosure should be used to protect the rights and interests of suppliers and related subjects, To ensure the authority of the law, it is necessary to make clear the legal responsibility, to ensure the authority of the law, and to strengthen the punishment of the violator in order to ensure the authority of the law.
