美国法上的网约车监管理论与实践——兼评七部门《网络预约出租汽车经营服务管理暂行办法》

【摘要】:美国法上的网约车监管理论与实践对于"去管制"以及网约车司机、乘客、其他利益相关者的保护不足问题进行了通盘考量。目前的美国法通过将Uber等网约车公司定性为"普通承运人"或者为其提供全新的监管类别、采用更为劳动者友好型的"雇员"认定方法等监管措施,试图实现创新与管制之间的利益平衡。中国目前的网约车监管法律规范已具有一定的科学性和合理性,但仍在网约车司机、乘客和其他利益相关者的利益保护问题上具有明显不足,需要参考美国法上有关理论与实践加以完善。
[Abstract]:The theory and practice of the regulation of ride-hailing in the law of the United States for "deregulation", as well as for drivers and passengers of ride-hailing, The inadequate protection of other stakeholders has been taken into account. Current US law characterizes ride-hailing companies such as Uber as "common carriers" or provides them with a completely new category of regulation. In order to achieve the benefit balance between innovation and regulation by adopting more laborer friendly "employee" identification methods, China's current legal norms on the regulation of ride-hailing in China are scientific and reasonable to a certain extent. However, there are obvious deficiencies in the protection of the interests of ride-sharing drivers, passengers and other stakeholders, which need to be improved by reference to the relevant theories and practices in American law.
