【摘要】: 市场经济的核心与灵魂是公平和竞争的竞争。而行政垄断是行政主体滥用行政权力,运用强制手段排斥、限制或妨碍合法竞争,破坏社会主义市场经济竞争关系,侵害市场公平竞争秩序的行为。改革开放以来政治体制改革的相对滞后,国家权力下放后控权举措的根本缺失,使行政垄断问题逐渐成为中国市场经济发展的重大障碍,具有严重的社会危害性,所以当前学界普遍认为“中国反垄断的主要任务是反行政垄断”。国家为了社会的整体利益和长远利益,走上了反行政垄断的漫长征途,从1980年国务院发布的《竞争十条》第一次提出了反行政垄断的任务以来,国家出台了众多与反行政垄断有关的法律法规和其他规范性文件,但在现实生活中许多条款形同虚设、功效甚微。 2007年8月30日,十届全国人大常委会第二十九次会议经表决通过反垄断法,这意味着,经过13年之久的争议和打磨,反垄断法终于尘埃落定,并于2008年8月1日起施行。该法以专章形式规制滥用行政权力限制竞争行为,但是还不是很完善,有诸多问题没有解决或者解决的不好。如何真正有效地规制行政垄断,全面研究和准确把握行政垄断,消除行政垄断的消极影响是亟待解决的问题。 本文对中国的行政垄断问题进行了全面深入的分析和论述,并提出了一系列解决中国转型时期行政垄断问题的具体措施。全文从以下三个方面对行政垄断展开了论述。 第一章,是对行政垄断进行总体上的介绍和阐释。首先,对行政垄断的概念加以界定;其次,对行政垄断的特征加以分析,揭示了行政垄断与经济垄断的区别。再次,根据辩证唯物主义的“内外因原理”,对行政垄断的产生成因进行深入探究,包括历史传统、现实因素、经济根源、法制缺陷。最后,综合分析行政垄断对市场竞争、经济自由、政治和社会的巨大危害。 第二章,笔者对国外行政垄断法律规制的历史和现状进行考察分析。东欧地区国家和前苏联地区国家在体制转型时期与我国有着相似的经历,它们从转型之初起就致力通过立法来规制行政垄断,大都有专门的反垄断法,并将反行政垄断作为重要组成部分;设置了专门的层级较高的反垄断机构,具有较高的权威性和独立性;同时对行政垄断的实施者处以较为严厉的法律责任。这些经验都是值得我们借鉴的。 第三章笔者将目光集中在影响法律规制行政垄断效益的法律内因上,分析了我国反行政垄断的立法现状和存在问题。本章主要从完善反垄断法、行政法和公共事业法对行政垄断的规制三个方面进行论述,提出要整体推进,分步构建,形成统一协调行政垄断法律规制体系。只有这样,才能更有效地约束行政权力运行,维护市场公平竞争秩序。
[Abstract]:The core and soul of the market economy are fair and competitive competition, while administrative monopoly is the abuse of administrative power by administrative subjects, exclusion by coercive means, restriction or hindrance of legitimate competition, and destruction of the competitive relationship of socialist market economy. The relative lag in the reform of the political system since the reform and opening up, and the fundamental absence of the measures of controlling power after the decentralization of state power, have gradually made the issue of administrative monopoly a major obstacle to the development of China's market economy. Because of its serious social harmfulness, it is generally believed that "the main task of anti-monopoly in China is to fight administrative monopoly". For the sake of the overall and long-term interests of the society, the country has embarked on a long journey of anti-administrative monopoly. Since 1980, when the State Council first put forward the task of anti-administrative monopoly, the State has issued many laws, regulations and other normative documents related to the anti-administrative monopoly. It has little effect. In August 30th 2007, the 29th session of the standing Committee of the Tenth National people's Congress passed the Anti-monopoly Law by vote. This means that after 13 years of controversy and grinding, the anti-monopoly law has finally been settled. The law regulates the abuse of administrative power to limit competition in the form of a special chapter, but it is not perfect, there are many problems that have not been solved or solved, and how to regulate the administrative monopoly effectively. It is an urgent problem to study and accurately grasp the administrative monopoly and eliminate the negative influence of the administrative monopoly. This paper makes a thorough analysis and discussion on the issue of administrative monopoly in China, and puts forward a series of concrete measures to solve the problem of administrative monopoly in the transitional period of China. The full text discusses the administrative monopoly from the following three aspects. The first chapter is the general introduction and interpretation of administrative monopoly. Firstly, it defines the concept of administrative monopoly; secondly, it analyzes the characteristics of administrative monopoly and reveals the difference between administrative monopoly and economic monopoly. According to the "internal and external cause principle" of dialectical materialism, the causes of the administrative monopoly are deeply explored, including historical tradition, realistic factors, economic root, legal defects. Finally, the comprehensive analysis of the administrative monopoly on the market competition, economic freedom, The great danger of politics and society. In the second chapter, the author investigates and analyzes the history and present situation of the legal regulation of foreign administrative monopoly. The countries of Eastern Europe and the former Soviet Union have similar experiences with our country in the period of system transformation. From the beginning of the transition, they have been trying to regulate administrative monopoly through legislation, most of them have special anti-monopoly law, and take the anti-administrative monopoly as an important part, and set up a special anti-monopoly agency with a higher level. It has higher authority and independence, at the same time impose more severe legal liability on the executors of administrative monopoly. These experiences are worthy of our reference. In the third chapter, the author focuses on the internal causes of the legal regulation of the benefit of administrative monopoly, and analyzes the current situation and existing problems of anti-administrative monopoly legislation in China. Administrative law and public utility law discuss three aspects of the regulation of administrative monopoly, and put forward that the administrative monopoly should be promoted as a whole, constructed step by step, and formed a unified and coordinated legal regulation system of administrative monopoly. Only in this way, can the administrative power be restricted more effectively. To maintain fair competition in the market.
