商业标识法律保护制度研究

【摘要】:商业标识是一种商品或者服务区别于其他商品或服务的显著的、特有的标记。伴随着当今社会的高度市场化,商业标识在市场竞争和社会生活中的地位节节攀升,并且,其在商品识别功能方面的作用愈发显著,当商业标识逐步充斥和影响着我们的日常生活时,对于附着在其自身的商誉价值的重要性则越来越凸显。在全球经济一体化的大背景下,我国的经济飞速发展,市场竞争趋于白热化,商业标识不仅能够在短时间内定位市场竞争者自身的服务或商品,又可以做到让该种服务或商品满足于使用或购买它的消费者,从而稳定市场经济秩序。但与此同时,部分市场竞争者为了在短时间内获得高利润,利用商业标识法律规制的不完善、不统一,使用各种不正当手段来侵害已有商业标识的合法权益,这类侵权或权利冲突行为使得商业标识本身所蕴含的内涵价值遭到严重损害,从而无法保障消费者的合法权益,破坏了市场经济秩序良性健康的发展。 我国对商业标识权益的保护主要分正反两方面:与商标相关的单行法主要从合理获得和使用商业标识的角度正面规制,如《商标法》、《企业名称登记管理办法》;而《反不正当竞争法》则是从反面角度保护商业标识的合法权益,即,通过禁止和救济的方式起到兜底作用。但是,市场经济的快速发展使得商业标识的侵权行为日趋新颖和多样化,从而导致与商标相关的单行法产生局限性,这就表明,完善《反不正当竞争法》对商业标识的合法权益的保护具有必要性和合理性,以此来调整我国现有竞争环境下商业标识的权利冲突。 本文除引言外主要分四个章节,第一章概括阐述了商业标识的基本理论,对商业标识基本概念、法律特征、类别以及侵权行为的主要原因做了介绍;第二章通过对典型案例的详述与案情分析,对我国商业标识法律保护的立法现状及存在的问题进行论证;第三部分主要参考介绍国外优秀商业标志保护制度并加以分析,从中得出对各国商业标识保护制度的立法借鉴;在第四部分的论述中,结合我国国情现状,对构建更加合理完善的商业标识法律保护体系提出完善措施,主要从确立基本原则,,完善“一般条款”,设置例外条款,以及完善法律责任条款这四个方面入手,提出合理措施,以期建立更加完善的商业标识法律保护体系。
[Abstract]:Business is a commodity or service is different from other goods or services significant, unique markers. With the highly developed market-oriented society, the status of commercial signs in the market competition and the social life of the rising, and its function in the identification of goods more and more significant role, when the commercial signs and gradually flooded affect our daily life, the importance attached to its own value of goodwill is increasingly prominent. In the background of global economic integration, China's rapid economic development, market competition intensified, commercial marks can not only locate in a short period of time the market competitors own goods or services, and can to make this kind of goods or services to meet the use or purchase it to consumers, and thus the stability of the order of the market economy. But at the same time, some competitors in the market in a short period of time to To obtain high profits, the legal regulation of commercial mark is not perfect, not unified, use improper means to infringe the legitimate rights and interests of the existing business logo, this kind of infringement or right conflict behavior makes commercial mark connotation itself contains the value of severely damaged, thus unable to safeguard the legitimate rights and interests of consumers, undermine the development of the market economic order healthy.
Our country to protect the interests of commercial signs is divided into two sides: Law and trademark related mainly from reasonable access and use of commercial mark point of positive regulation, such as the "trademark law", "administrative measures for the registration of the enterprise name >; and" law against unfair competition is from opposite angle of the protection of commercial marks the legitimate rights and interests, namely, the prohibition and remedy to reveal all the details. However, the rapid development of market economy makes the commercial mark infringement behavior is more novel and diverse, which leads to a single law and trademark related limitation, which indicates that with the rationality and necessity of perfecting the protection of "Anti Unfair Competition Law > of commercial mark the legitimate rights and interests, in order to adjust the conflict of rights of business signs under the current competitive environment in our country.
In addition to the introduction this paper is divided into four chapters, the first chapter expounds the basic theory of the legal characteristics of commercial signs, business signs, basic concepts, main reason and tort categories are introduced; the second chapter through detailed case analysis on typical cases, to demonstrate the status of legislation on the legal protection of commercial marks in China and the existing problems; the third part mainly introduces the foreign commercial reference mark protection system and analysis, draw lessons for commercial mark protection system of national legislation; in the fourth part, combined with the present situation of our country, the legal protection system of commercial signs to building a more reasonable and perfect put forward improvement measures, mainly from establish the basic principles, improve the general terms, set the exception clause, and perfect the legal liability provisions of these four aspects, put forward reasonable measures, in order to To establish a more perfect legal protection system for commercial signs.
