【摘要】：随着人们生活水平的不断提高,汽车重要性逐渐的凸显出来,但是在汽车给我带来便利的同时也给我们的生活带来了许多的负面影响。家庭消费汽车的过程,由于汽车这种产品的高科技性与特殊性,时常给我们的家庭带来不可避免的纠纷,尤其是经营者们为了获得更多的非法利益,在汽车销售的过程中“以旧当新”的方式欺诈消费者,严重侵害了消费者合法权益。而对于这种汽车消费过程的欺诈行为在实践中很难认定,已经成为我国法院审判过程中的一个难点问题。本文主要分为四个部分,对朱兴万汽车消费维权案件进行具体的分析：第一章具体介绍朱兴万汽车销售维权这个案件,找出该案件中的争议焦点问题。第二章分析本案件中纠纷的性质及其在审理过程中法院所适用的法律。第三章主要对这案件的焦点问题进行法律分析。通过具体分析惩罚性赔偿的构成要件及其欺诈的认定,及其对比其他案件的方式,分析本案的焦点问题。第四章通过对朱兴万案件的分析,对我国的惩罚性赔偿制度进行反思,提出自己的意见。
[Abstract]:With the continuous improvement of people's living standards, the importance of automobile is gradually highlighted, but the automobile brings me convenience and also brings many negative effects to our life. Because of the high-tech nature and particularity of this product, automobile often brings inevitable disputes to our families, especially the operators in order to obtain more illegal benefits. In the process of automobile sale, the consumers are fraudulently fraudulently "old as new", which seriously infringes on the legitimate rights and interests of consumers. However, it is difficult to identify the fraudulent behavior in the process of automobile consumption in practice. It has become a difficult problem in the course of court trial in our country. This paper is mainly divided into four parts, which analyzes the case of Zhu Xingwan's auto consumption rights. The first chapter introduces the case of Zhu Xingwan's auto sales rights. Chapter two analyzes the nature of the dispute in this case and the law applicable to the court during the trial. Chapter 3 mainly analyzes the focus of the case. Analysis of the elements of punitive damages and the identification of fraud, The fourth chapter, through the analysis of Zhu Xingwan case, reflects on the punitive damages system of our country and puts forward its own opinions.
