地区间建立横向生态补偿制度研究

【摘要】：横向生态补偿制度是为实施横向生态补偿而建立的一系列法律、经济和行政手段的总和,是对补偿主体、补偿对象、补偿标准、补偿方式、监管评估等核心内容作出的规则性安排。根据十八届三中全会提出的"推动地区间建立横向生态补偿制度"以及十八届四中全会提出的"制定完善生态补偿等领域的法律法规"的要求,在系统分析横向生态补偿内涵和特征的基础上,提出公共物品理论、产权理论、生态产品价值理论、外部性理论、法治理论是确定补偿主体、补偿对象、补偿标准、补偿方式、监管评估的重要理论基础。围绕"谁来补、补给谁、补多少、如何补、如何管"等核心内容设计了地区间横向生态补偿制度框架,研究提出要按照"谁受益谁补偿"的原则,通过合理确定生态受益区范围明晰补偿主体;按照"谁保护谁受偿"的原则,通过完善"四权分置"的自然资源资产产权制度明晰补偿对象;以边际成本法和双方博弈法为依据,确定科学合理并且现实可行的补偿标准;综合运用公共政策手段和市场手段,探索灵活多样的补偿方式;以公平公正公开为主要原则,建立多元参与和双向对等的监管评估体系和动态调整机制。本文还提出了实施横向生态补偿制度的相应配套措施。
[Abstract]:The horizontal ecological compensation system is the sum of a series of laws, economic and administrative means established for the implementation of horizontal ecological compensation. It is the main body of compensation, the object of compensation, the standard of compensation and the way of compensation. Domain of laws and regulations "requirements, Based on the systematic analysis of the connotation and characteristics of horizontal ecological compensation, this paper puts forward the theories of public goods, property rights, ecological products value, externality and rule of law, which are the determination of the main body of compensation, the object of compensation, the standard of compensation and the way of compensation. The important theoretical basis of supervision and evaluation. Around the core contents of "who will make up, who supplies who, how much, how to make up, how to manage" and other core contents, this paper designs the framework of horizontal ecological compensation system between regions, and puts forward the principle of "who benefits who compensates". According to the principle of "who protects who receives compensation", the compensation object is clarified by perfecting the property right system of natural resources assets with "four rights divided". Based on the marginal cost method and the game law of both sides, it determines the scientific, reasonable and practical compensation standard; comprehensively utilizes public policy and market means to explore flexible and diversified compensation methods; and regards fairness, justice and openness as the main principle, The system of supervision and evaluation and the dynamic adjustment mechanism of multi-participation and bidirectional equivalence are established. The corresponding supporting measures for the implementation of the horizontal ecological compensation system are also put forward in this paper.
