论我国自由贸易试验区差异化竞争与合作的立法保障

【摘要】：至2017年4月第三批自贸试验区挂牌,我国已陆续启动了三批次自贸试验区建设,自贸试验区进入集群发展阶段。自贸试验区未来的发展必然是合作与竞争并存的态势。自贸试验区差异化试验模式探索过程中的规范运行离不开立法保障,各自贸试验区之间的统筹分工、合作亦离不开中央和地方层面的综合立法体系支撑。现行自贸试验区在运行过程中存在顶层法律缺位、地方法规创制权限不清、竞争中立法律不完善、协同合作法规缺失等问题。解决这些系列问题的核心是制度创新,尤其是中央和地方职权分明、主体地位充分得以发挥的立法创新。通过顶层设计与地方探索立法的联动,细化自贸试验区的差异化法制环境建设,构建完善的自贸试验区管理机构和评估体系,实现自贸试验区法制创新,将是自贸试验区推进的可行路径。
[Abstract]:By April 2017, the third batch of free trade pilot areas have been listed, and China has started the construction of three batches of free trade test areas one after another. The free trade test area enters the cluster development stage. The future development of the free trade test area is bound to be the coexistence of cooperation and competition. The standard operation in the process of exploring the differentiation test mode of the free trade test area can not be separated from the legislative guarantee. The overall division of labor among the respective trade test areas and cooperation can not be separated from the support of the comprehensive legislative system at the central and local levels. In the current free trade experimental areas, there is a lack of top-level laws in the course of operation, and local laws and regulations have unclear powers to create them. The core of solving these series of problems is institutional innovation, especially the clear distinction between central and local authorities. Through the linkage of top-level design and local exploration of legislation, the construction of differentiated legal environment in FTAZ is refined, and a perfect management and evaluation system of FTAZ is constructed. Realizing the legal innovation of the free trade test area will be the feasible way to promote the free trade test area.
