我国利率市场化的法律调控研究

【摘要】：利率市场化改革是我国金融体制改革当中最为重要的环节，它对于平衡资金的供求关系，提高资金的利用效率，发挥政府宏观调控职能和提升商业银行等金融机构的经营水平具有十分重要的意义。我国自1996年开始对利率管制的改革使得利率市场化改革快速推进。目前，，利率市场化已进入冲刺阶段。2015年3月1日起，中国人民银行对人民币存款和贷款基准利率进行调整，而在2015年两会期间，李克强总理在政府报告当中也提出要推进利率市场化改革，健全中央银行利率调控框架。这意味着利率市场化改革已经到了临门一脚的境地。然而，利率市场化改革是一个全面而复杂的过程，离不开法律法规的引导与规范。文章分析了利率市场化中相关主体的法律关系，论述了我国利率市场化进程中法律调控的理论基础和必要性，通过分析我国利率市场化法律调控存在的问题，在借鉴美国、日本和台湾地区的利率市场化法律调控经验的基础上，对我国利率市场化改革的法律调控提出建议。实证分析法、比较分析法和文献研究法是本文最常用的三种方法，而本文的创新之处主要在于，国内现有的关于利率市场化法律问题的著作大都采用的是整体上分析和提出问题并解决问题的方式，此前的著作并没有对法律调控问题进行专门研究。在参考此前学者研究的基础之上，对我国利率市场化改革进行理论分析和法律调控必要性分析，本文的研究角度侧重于弥补利率市场化法律调控研究的空白，在其中提出新的观点，例如对我国今后在利率市场化法律调控的一些具体建议等等，同时，对今后的研究具有一定的参考和指导意义。
[Abstract]:The reform of interest rate marketization is the most important link in the reform of China's financial system. It can balance the supply and demand of funds and improve the efficiency of the use of funds. It is of great significance to give full play to the government's macro-control function and to improve the management level of financial institutions such as commercial banks. The reform of interest rate regulation in China since 1996 has made the reform of interest rate marketization move forward rapidly. Interest rate liberalization has entered the stage of sprint. From March 1, 2015, the people's Bank of China adjusted the benchmark interest rates on renminbi deposits and loans, while during the two sessions in 2015, In his government report, Premier Li Keqiang also proposed to push forward the interest rate marketization reform and improve the central bank's interest rate regulatory framework. This means that the interest rate marketization reform has reached a crucial stage. However, the reform of interest rate marketization is a comprehensive and complex process, which can not be separated from the guidance and standardization of laws and regulations. This paper discusses the theoretical basis and necessity of legal regulation and control in the process of interest rate marketization in our country. By analyzing the problems existing in the legal regulation and control of interest rate marketization in China, the author draws lessons from the United States. On the basis of the experience of legal regulation and control of interest rate marketization in Japan and Taiwan, this paper puts forward some suggestions on the legal regulation and control of interest rate marketization reform in China. The empirical analysis method, comparative analysis method and literature research method are the three most commonly used methods in this paper. The main innovation of this paper is that most of the domestic works on the legal issues of interest rate marketization mostly adopt the way of analyzing and raising problems as a whole and solving them. Previous works have not specifically studied the issue of legal regulation and control. On the basis of reference to previous studies by scholars, the theoretical analysis and the analysis of the necessity of legal regulation of interest rate marketization reform in China have been carried out. The research angle of this paper focuses on making up the gaps in the study of legal regulation and control of interest rate marketization, and puts forward some new points of view, such as some specific suggestions on the legal regulation of interest rate marketization in the future in China, etc., at the same time, It has certain reference and guiding significance for future research.
