跨境担保外汇管理政策执行中的问题及建议

【摘要】：《跨境担保外汇管理规定》实施两年以来,便利了跨境担保业务办理的同时暴露出了履约风险加大、融资诈骗等隐忧,控流出形式下,影响了新政策实际效果。笔者从审核担保履约可能性、担保合同商业合理性、股权担保前置管理等六个方面进行了分析,提出了管理建议,旨在完善跨境担保管理,堵塞漏洞。
[Abstract]:Since the implementation of the "regulations on the Administration of Cross-border secured Foreign Exchange" two years ago, it has facilitated the handling of cross-border guarantee business and exposed such hidden worries as increased performance risk, financing fraud, and so on, which have affected the practical effect of the new policy under the form of control and outflow. The author analyzes the possibility of security performance, the commercial rationality of guarantee contract and the pre-management of equity guarantee, and puts forward some management suggestions in order to perfect the management of cross-border guarantee and plug the loopholes.
