《韩美自由贸易协定》的若干法律问题研究

【摘要】：《韩美自由贸易协定》(简称韩美FTA)是美国与大韩民国的双边自由贸易协定。名义上该协定是为了强化双方的伙伴关系,并建立更加紧密的经济关系而签订的。名义上通过缔结该协定,为双方辖区内的商品和服务创建一个更加广阔和稳定的市场,为投资者提供更加稳定和可预测的投资环境,从而提高缔约双方的公司在全球市场的竞争力。协定的主要内容包括农业、工业、服务业、汽车、纺织品、投资者保护、知识产权保护以及劳工权利和环境保护等内容。2012年3月15日,韩美FTA正式生效,韩国为了实施韩美FTA而修改的法律法规多达70余部,并且若干公共政策因为韩美FTA被推迟或废除。非转基因标志制度改革等甚至直接威胁着韩国国民的健康。韩美FTA项下,美资获得了几乎无所限制的投资范围以及只要是美国投资者均可以根据韩美FTA的争议解决(ISD)条款起诉韩国政府的韩美FTA第11章,这一切损害了韩国的国家利益。随着特朗普新总统的胜出,韩美FTA再度成为各界关注的焦点,很多人担忧该协定的废除或重启谈判可能使韩国国民利益再度受到损害。但是笔者认为,如果特朗普总统提出重新修订韩美FTA,对韩国民众来说也许是天赐良机。借此机会,韩国可以拒绝韩美FTA,然后加大与中国的经济联系。当然这一切基于萨德问题的妥善解决。因为经济、军事、政治毕竟有着密切的联系。很多人认为,美国重起韩美FTA谈判,将陷韩国于危局。但是作者认为,这或许是韩国转危为机的关键节点。
[Abstract]:The Korea-US Free Trade Agreement (FTAA) is a bilateral free trade agreement between the United States and the Republic of Korea. The agreement was signed nominally to strengthen partnership and build closer economic ties. Nominally, through the conclusion of the agreement, a broader and more stable market for goods and services within the respective jurisdictions is created and a more stable and predictable investment environment for investors is provided, Thus enhancing the competitiveness of the contracting parties in the global market. The main contents of the agreement include agriculture, industry, services, automobile, textiles, investor protection, intellectual property protection, labor rights and environmental protection. On March 15, 2012, South Korea and the United States FTA came into effect. South Korea has amended more than 70 laws and regulations to implement the FTA, and several public policies have been delayed or repealed because of the FTA. The reform of non-GM marker system is even a direct threat to the health of Korean people. Under FTA, the United States received almost unlimited investment and any American investor could sue the South Korean government under FTA's dispute Resolution Section 11, all of which hurt South Korea's national interest. With the victory of Trump's new president, South Korea and the United States FTA have once again become the focus of attention, with many worried that the abrogation of the agreement or the resumption of negotiations could once again hurt South Korea's national interests. But I believe that if President Trump proposes to revise the FTAs in South Korea and the United States, it may be a godsend to the South Korean people. This is an opportunity for South Korea to reject the FTAA and increase its economic ties with China. Of course, all this based on the proper settlement of the THAAD problem. Because economy, military, politics after all have close connection. Many people believe that the United States to resume the FTA negotiations between South Korea and the United States, South Korea will be in danger. But the author thinks, this may be the key node that South Korea turns into an opportunity.
