中国汽车行业反垄断研究

【摘要】:随着中国经济的快速发展和人民物质需求的急剧增加,作为世界第二大经济体的中国,其国内汽车销售量急剧增多,据中国汽车工业协会统计的数据,2013年中国汽车销售市场销售了2349万辆汽车,相比2012年增长了13.87%,中国汽车销售量已远超作为世界第一大经济体的美国。人们在关注于中国汽车工业的发展和庞大的汽车销售量时,也在关注中国汽车行业流通和售后领域存在的诸多问题。2013年,一股关于“中国汽车行业存在垄断”的议题风暴席卷中国大地,许多的专家学者开始探索中国汽车行业存在的“垄断秘密”,诸如:汽车行业是否存在垄断价格协议、捆绑销售、行政垄断、区域限售等。2014年中国发展与改革委员会证实了中国汽车及相关的行业存在垄断行为,并进行了相关的反垄断处罚。中国汽车行业具体在哪些方面存在垄断问题,哪些垄断是需要依据《反垄断法》去处罚的,中国政府对汽车行业怎样实施了反垄断措施,相比欧美国家还有那些不足,具体如何改进等将是本文要去研究的。本文首先对中国汽车行业存在的垄断现象和当前反垄断实施情况进行了介绍。中国汽车行业存在的垄断现象分为垄断模式和垄断行为,垄断模式主要是指汽车行业在生产销售汽车的地位上处于垄断,垄断行为包括汽车的销售价格协议、区域限售、搭售、汽车零配件和售后的垄断以及行政垄断等。《反垄断法》并非遇见垄断现象就要去处罚,汽车行业的垄断行为是需要去消除和解决的,而垄断模式则要酌情对待的。其次,介绍了欧美国家的汽车流通领域的情况,以及其针对汽车行业实施反垄断的法律依据和反垄断的手段。相比中国,在针对汽车行业实施反垄断的措施上,还有诸多的不足。最后提出中国针对汽车行业反垄断在司法健全、执法机构完善、市场公平竞争、向美欧学习相关的反垄断知识等方面的对策和建议。
[Abstract]:With the rapid development of China's economy and the rapid increase of people's material needs, China, the world's second largest economy, has witnessed a sharp increase in domestic car sales. China's auto market sold 23.49 million cars in 2013, an increase of 13.87 from 2012, according to the China Association of Automobile Manufacturers, which has far surpassed the United States, the world's largest economy. While focusing on the development of China's auto industry and the huge number of auto sales, people are also looking at the problems in the circulation and aftermarket sectors of China's auto industry. A storm on the topic of "monopoly in China's automobile industry" swept across China. Many experts and scholars began to explore the "monopoly secrets" that exist in China's automobile industry, such as whether there is a monopoly price agreement in the automobile industry. The China Development and Reform Commission (DRC) confirmed the existence of monopolistic practices in China's automobile and related industries in 2014 and imposed related antitrust penalties. In what areas does China's auto industry have monopoly problems, which monopolies need to be punished in accordance with the Anti-Monopoly Law? how did the Chinese government implement anti-monopoly measures against the auto industry, compared with those in Europe and the United States? How to improve and so on will be studied in this paper. This paper first introduces the monopoly phenomenon in China's automobile industry and the current situation of anti-monopoly implementation. The monopoly phenomenon in China's automobile industry can be divided into monopoly mode and monopoly behavior. The monopoly mode mainly refers to the monopoly of automobile industry in the status of production and sale of vehicles. The monopoly behavior includes sales price agreement, regional restricted sale, tied sale, etc. Auto parts and after-sale monopoly and administrative monopoly. Anti-monopoly Law is not to be punished in the face of monopoly phenomenon. The monopoly behavior of automobile industry needs to be eliminated and solved, while the monopoly mode should be treated with discretion. Secondly, it introduces the situation of automobile circulation in Europe and the United States, and the legal basis and means of antimonopoly in view of automobile industry. Compared with China, there are many shortcomings in the implementation of anti-monopoly measures against the auto industry. At last, some countermeasures and suggestions are put forward in view of the perfection of judicature, law enforcement, fair competition in the market, and learning antitrust knowledge from America and Europe.
