船舶残骸清除费用法律问题研究

【摘要】:2007年通过的《内罗毕国际船舶残骸清除公约》,时隔八年,终于在2015年4月14日开始生效。这是国际上第一个系统性调整船舶残骸打捞法律问题的国际公约,这一公约的生效给国际上船舶残骸打捞工作指明了方向,也给我国船舶残骸打捞带来了挑战。《内罗毕国际船舶残骸清除公约》明确了对船舶残骸定位、标记以及强制责任保险或其他经济担保等制度,规定了船舶登记所有人对其登记所有的构成危害的船舶残骸负有打捞清除并承担清除费用的责任。本文在对公约重点条款进行分析的基础上,采用对比分析法,将我国相关制度与公约规定进行比较分析,重点论述船舶残骸清除费用的法律问题,为实践中船舶残骸清除费用的实现提供理论支撑。本文共分为四个部分。第一部分首先明确船舶残骸的范围,然后采用具体问题具体分析的方法,分情况进行讨论,对不同类别的船舶残骸打捞方式分别界定船舶残骸清除费用的性质。第二部分分析承担船舶残骸清除费用的责任主体,只要明确了船舶残骸清除费用的承担者,就解决了在实践中费用向谁索赔的问题。第三部分分析船舶残骸清除费用是否属于限制性债权,这一点,我国的立法思路与公约不一致,然而是能否享受责任限制对船舶残骸清除费用的实现有一定的影响。第四部分探讨船舶残骸清除费用的实现机制,实践中最关心的问题就是船舶残骸清除费用的实现。在借鉴公约的基础上,完善我国相关机制,在理论上提出解决船舶残骸清除费用问题的方法。本文采用理论与实践相结合的方法,同时借鉴国际立法,为解决我国船舶残骸清除费用的法律问题提出对策。
[Abstract]:The Nairobi Convention on the removal of wreckage, adopted in 2007, came into force on April 14, 2015, after eight years. This is the first international convention to systematically regulate the legal issue of the salvage of ship wreckage. The entry into force of this convention has pointed out the direction for the salvage of wreckage in the international community. The Nairobi Convention on the removal of wreckage clearly defines the systems for the positioning, marking, compulsory liability insurance or other economic guarantees of ship wreckage. The owner of the ship's register shall be responsible for the salvage and removal of all hazardous wreckage registered by the ship. Based on the analysis of the key articles of the Convention, this paper makes a comparative analysis of the relevant systems of our country and the provisions of the Convention by means of comparative analysis, and focuses on the legal issues of the cost of wreckage removal. It provides theoretical support for the realization of the cost of ship wreckage removal in practice. This paper is divided into four parts. In the first part, the scope of ship wreckage is defined, and then the method of concrete analysis is used to discuss the situation, and the nature of the cost of wreckage removal is defined respectively for different types of ship wreckage. The second part analyzes the main body responsible for the cost of wreckage removal. As long as the payer of the cost of wreckage removal is defined, the problem of who claims for the cost in practice will be solved. The third part analyzes whether the cost of wreckage removal is a restrictive claim, which is inconsistent with the legislation of our country. However, the limitation of liability has a certain impact on the realization of the cost of wreckage removal. In the fourth part, the realization mechanism of the cost of wreckage removal is discussed. The most concerned problem in practice is the realization of the cost of wreckage removal. On the basis of reference to the convention and perfecting the relevant mechanism of our country, this paper puts forward a method to solve the problem of the cost of wreckage removal in theory. By combining theory with practice and drawing lessons from international legislation, this paper puts forward some countermeasures to solve the legal problem of the cost of wreckage removal in China.
