论诉讼财产保全保险的模式选择

【摘要】：诉讼财产保全保险是一种用于替代传统诉讼财产保全担保的新型保险,存在责任保险和保证保险两种产品模式。保证保险模式下,赔偿责任直接指向保全被申请人的损失;责任保险模式下,赔偿责任针对保全申请人的侵权责任,存在条款设计不符合责任保险要求、保单保函构成保险之外的保证责任等风险。诉讼财产保全保险应采用保证保险的模式,由保险公司向法院出具保单说明函,发挥对诉讼财产保全担保的替代功能。责任保险模式的诉讼财产保全保险可以保留,但应回归防范侵权责任之本质,与法院审查诉讼财产保全申请并无关联。建议最高人民法院与中国保监会联合出台指导文件,并由中国保险行业协会牵头制定行业示范保险条款和保单说明函样本。
[Abstract]:Litigation property preservation insurance is a new type of insurance which is used to replace the traditional litigation property preservation guarantee. There are two product modes: liability insurance and guarantee insurance. Under the mode of guarantee insurance, the liability directly refers to the preservation of the losses of the respondent; under the mode of liability insurance, the liability is directed against the tort liability of the preservation applicant, and the design of the existing clauses does not meet the requirements of liability insurance. The policy guarantee constitutes the risk of warranty other than insurance. The insurance of litigation property preservation should adopt the mode of guaranty insurance, and the insurance company should issue a letter of note to the court to give play to the substitute function of the guarantee for the preservation of litigation property. Litigation property preservation insurance of liability insurance model can be retained, but should return to the nature of tort protection liability, and has no relation with court examination of litigation property preservation application. It is suggested that the Supreme people's Court and the China Insurance Regulatory Commission jointly issue guidance documents and that the China Insurance Industry Association take the lead in formulating model insurance clauses and sample policy notes.
