论船舶优先权之正名

【摘要】:我国《海商法》中关于船舶优先权的规定,是根据国际惯例,并参照1993年《船舶优先权和抵押权国际公约》制定的,旨在保证债权人依法提出的特殊海事请求,对产生该海事请求的船舶,享有优先受偿的权利。然而由于法律传统和法律体系的不同,船舶优先权作为Maritime Lien在我国相对应的法律概念和法律制度,以其概念为核心,引发了诸多误解和争议。因此,本文从Maritime Lien的缘起和发展出发,探究Maritime Lien的本意和性质,结合船舶优先权制度在我国法律土壤上所带来的问题和原因,提出“船舶法定抵押权”这个替换概念,来解决船舶优先权带来的问题,澄清误解,更好地实现其制度本身的价值和功能。第一部分研究船舶优先权的缘起,从英美法系制度和国际条约中探究Maritime Lien的性质;第二部分分析船舶优先权概念在中国法律领域所带来的立法、司法、学术交流中的争议和问题;第三部分阐述“船舶法定抵押权”对于解决这些问题的优越性价值;第四部分阐述立法者引入船舶优先权概念的初衷,进一步说明“船舶法定抵押权”对于替代船舶优先权并无实质障碍;第五部分对于我国立法和司法程序提出建议,希望能够为《海商法》的修改提供一些启示和帮助。
[Abstract]:The provisions on maritime liens in China's Maritime Law are formulated in accordance with international practice and with reference to the 1993 International Convention on Maritime liens and mortgages, in order to guarantee the special maritime claims submitted by creditors in accordance with the law. The ship in which the maritime claim arises shall have the right of priority. However, due to the difference between legal tradition and legal system, maritime lien, as the corresponding legal concept and legal system of Maritime Lien in China, takes its concept as the core, which leads to many misunderstandings and disputes. Therefore, starting from the origin and development of Maritime Lien, this paper probes into the original intention and nature of Maritime Lien, combines the problems and reasons brought about by the maritime lien system in our country's legal soil, and puts forward the replacement concept of "legal mortgage on ships". To solve the problems caused by maritime liens, clarify misunderstandings, and better realize the value and function of the system itself. The first part studies the origin of maritime lien, explores the nature of Maritime Lien from the Anglo-American legal system and international treaties, the second part analyzes the legislation and judicature brought about by the concept of maritime lien in the field of Chinese law. The third part expounds the superiority value of "legal mortgage of ship" in solving these problems, the fourth part expounds the original intention of introducing the concept of maritime lien. It is further explained that there is no substantial obstacle to the substitution of maritime liens by "statutory mortgage on ships", and in the fifth part, some suggestions are put forward for the legislative and judicial procedures of our country, hoping to provide some enlightenment and help for the amendment of Maritime Law.
