海事主管机关强制干预行为问题研究

【摘要】:实践中海事主管机关应对、处理海上事故,在维护海上交通安全、保护海洋环境方面发挥着不可忽视的作用,具体表现为强制清污、强制打捞清除和强制拖带等带有一定公法性质的行为,本文将上述行为统称为海事主管机关的“强制干预行为”。本文试图分析海事主管机关强制干预行为的相关法律问题。第一章对海事主管机关基于公共利益进行强制干预行为的特点及法律依据进行了概括说明;第二章着重研究海事主管机关强制干预行为的法律性质,通过将其与国家主管机关从事和控制的海难救助、强制救助进行对比分析,确认了其行政代履行的公法性质;第三章主要分析海事主管机关强制干预行为的条件、边界及违法干预的赔偿等问题,以图保障行政相对人的合法权益;第四章则重点讨论了海事强制干预行为所产生的费用的性质以及如何实现问题,并对其后续保障提出了意见和建议。总之,本文旨在厘清海事主管机关强制干预行为与其从事和控制的海难救助之间的关系,并且指出海事主管机关的这种公法性行为不宜被称为“强制救助”,更不应放入海难救助法律关系中调整,而应列入海事行政强制体系中进行考察。同时,本文还研究了海事主管机关在什么条件下可以实施强制干预行为以及如何实施、权力界限何在等问题,并对实践中经常引起争议的费用实现问题提出了建议,希望本文的研究结论能够使海事主管机关与相对人的权益得到平衡。
[Abstract]:In practice, maritime authorities should deal with accidents at sea and play an important role in maintaining maritime traffic safety and protecting marine environment. Compulsory salvage removal and compulsory towing are some public law acts, which are referred to as "compulsory intervention" by maritime authorities in this paper. This paper attempts to analyze the relevant legal issues of compulsory intervention by maritime authorities. The first chapter summarizes the characteristics and legal basis of compulsory intervention by maritime authorities on the basis of public interest. The second chapter focuses on the legal nature of compulsory intervention by maritime authorities. By comparing it with the salvage at sea engaged in and under the control of the competent national authority, the compulsory salvage confirms the public law nature of its administrative performance. Chapter III mainly analyzes the conditions for the compulsory intervention by the maritime competent authority. In order to protect the legitimate rights and interests of the administrative counterpart, the fourth chapter focuses on the nature of the cost incurred by the maritime compulsory intervention and how to realize it. And put forward the opinion and suggestion to its follow-up safeguard. In a word, the purpose of this paper is to clarify the relationship between the compulsory intervention of maritime authorities and the salvage at sea which they engage in and control, and to point out that such public law acts of maritime authorities should not be called "compulsory salvage". It should not be adjusted in the legal relationship of salvage at sea, but should be included in the compulsory system of maritime administration. At the same time, this paper also studies the conditions under which maritime authorities can carry out compulsory intervention, how to implement it, and where the limits of power are, and puts forward some suggestions on how to realize the costs that often cause controversy in practice. It is hoped that the conclusion of this paper can balance the rights and interests of the maritime authorities and the relative parties.
