旅游辅助者致旅游者损害时的责任承担问题

【摘要】：在当今世界,旅游行业素有朝阳产业之称,旅游产业的繁荣旺盛使得各国都将其作为发展本国经济的重要方式之一。然而,在旅游消费日益繁盛的今天,出现的旅游纠纷现象也日益纷繁复杂,旅游活动多涉及旅游者、旅行社以及旅游服务辅助者等多个主体,这就使得互相之间的责任也趋于复杂化,尤其是在旅游辅助者造成旅游者人身或财产损害的情况下,旅行社与旅游辅助者的责任该如何划分的问题。现实生活中,常常出现旅行社与旅游辅助者互相推诿责任的现象,同时因我国相关法律规定还不够完善,进而也出现了各地法院对类似纠纷案件做出不同处理的现象,这将不利于对旅游者合法权益的保护以及整个旅游产业的健康发展,于是如何很好地处理此类旅游纠纷案件则成了一个迫切需要予以解决的问题。同时,由于我国正式的《旅游法》刚出台不久,其对旅行社或者旅游辅助者造成旅游者损害时的责任承担问题进行了一定程度上的明确,故本文欲在之前相关法律已有规定的基础上,再结合新出台的《旅游法》中的相关规定,来对旅游辅助者造成旅游者人身或财产损害时的责任承担问题进行一定的阐述,以期对以后司法实践中出现的此类旅游纠纷案件给予一定的帮助。本文主要分为六个部分:引言主要介绍本文写作的研究背景与意义,主要包括旅游纠纷的日益繁多以及复杂化,新出台的《旅游法》突出对旅游者权益的保障等;第二部分则从一则案例提出问题,首先介绍案件的基本情况,而后阐述案件的最终判决以及判决的依据,从案例中抽象出文章将要涉及的问题,即旅游辅助者致旅游者人身或财产损害时的责任承担问题;第三部分主要分析旅游者、旅行社、旅游辅助者三方的法律关系,分别讨论了旅游者与旅行社、旅行社与旅游辅助者、旅游者与旅游辅助者相互之间存在的法律关系,以方便下文展开对造成旅游者损害的责任承担问题的讨论;第四部分则对旅游辅助者的法律地位进行说明,首先介绍了旅游辅助者的界定问题,以明确旅游辅助者的身份,排除非旅游辅助者,而后进一步讨论旅游辅助者的法律地位;第五部分则分析旅游辅助者致旅游者人身或财产损害时的责任承担问题,本部分采取责任二分体系,对违约责任与侵权责任进行分开讨论,而后对该两种责任产生竞合的情形进行简单的分析;最后给本文做一总结。
[Abstract]:In today's world, the tourism industry is known as the sunrise industry, and the prosperity of the tourism industry has made all countries take it as one of the important ways to develop their own economy. However, in the day of the growing tourism consumption, the phenomenon of tourism disputes is increasingly complex, and travel activities involve tourists, travel agencies and tourism services. It makes the responsibility of each other more complicated, especially the problem of how to divide the responsibility of the travel agency and the tourist assistant in the case of the tourist's personal or property damage caused by the tourist assistants. In real life, the phenomenon of passing the responsibility of the travel agency and the tourist assistants often appears in the real life. At the same time, because the relevant laws and regulations of our country are not perfect enough, there is also a phenomenon of different handling of similar disputes in various courts, which will not help the protection of the legitimate rights and interests of tourists and the healthy development of the whole tourism industry. So how to deal with such cases is an urgent need. In order to solve the problem, at the same time, because the official "tourism law" of our country has just come out soon, it has a certain degree of responsibility for the travel agency or tourist assistant caused by tourist damage, so this article will be based on the previous relevant laws, and then combine the relevant regulations of the new tourism law. In order to give some help to the tourist disputes in the future, this article is divided into six parts: the introduction mainly introduces the background and significance of the study, mainly including the tourist disputes. In the second part, the basic situation of the case is introduced, the final judgment of the case and the basis of the judgment are expounded, and the problems that the article will be involved in the case are abstracted from the case, that is, tourism assistants to travel. In the third part, the legal relationship between tourists, travel agencies and tourist assistants is analyzed, and the legal relations between tourists and travel agencies, travel agencies and tourist assistants, tourists and tourist assistants are discussed respectively in the third part. In the fourth part, the legal status of tourist auxiliaries is explained. First, the definition of tourist auxiliaries is introduced to clarify the identity of tourist auxiliaries, to exclude non tourist auxiliaries, and then to further discuss the legal status of tourist auxiliaries, and the fifth part of the analysis of tourism assistants to tourism. In the case of liability for personal or property damage, this part takes the two part of the responsibility system, discusses the liability for breach of contract and the liability of tort separately, and then makes a simple analysis of the situation of the concurrence of the two kinds of responsibilities; finally, a summary is given to this article.
