广东自由贸易试验区若干法律问题研究

【摘要】：广东自由贸易试验区的法律问题既包含有我国自由贸易试验区共同的法律问题,也有其自身特有的亟需回应的法律难题。文章对广东自由贸易试验区自身特有的法律问题包括自由试验区的管理体制、涉港澳服务贸易准入制度以及海关监管制度的法律问题进行研究并针对性地提出构建具有广东自由贸易试验区“可复制、可推广”特色的制度建议。全文包括引言、正文、结论三部分。正文分为四章。第一章对世界自贸区基本理论进行法理分析,以法律概念、分类标准、法律特征、法律地位以及研究意义等五个纬度展开。第二章对广东自由贸易试验区管理体制进行分析,基于自贸区的宏观管理体制和微观体制两个层面,比照境内外自由贸易试验区管理模式,提出广东自由贸易试验区目标模式以及需要克服的难点。第三章对广东自由贸易试验区涉港澳服务贸易准入制度进行分析,以CEPA服务贸易在准入前后法律障碍为切入,结合国际、国内服务贸易法律规则,广东自由贸易试验区在理顺有关服务贸易法律授权范围的前提下,在现有权限基础上争取获得更多立法授权,提出涉港澳贸易服务制度突破点和解决方案。第四章以国际海关法为法理基础,对广东自由贸易试验区的海关监管制度展开分析,结合广东自由贸易试验区三大片区制度现状,剖析不足并提出具有广东自由贸易试验区特色的海关监管制度的方案。
[Abstract]:The legal problems of Guangdong Free Trade Test Zone include not only the common legal problems of China's Free Trade Test Zone, but also its own unique legal problems that need to be answered. The article deals with the special legal problems of the Guangdong Free Trade Test Zone, including the management system of the Free Trade Test Zone. This paper studies the legal issues concerning the admission system of service trade in Hong Kong and Macao as well as the customs supervision system, and puts forward some suggestions on the establishment of a "replicable and popularized" system with the characteristics of Guangdong free trade experimental area. The full text includes the introduction, the text, the conclusion three parts. The text is divided into four chapters. The first chapter analyzes the basic theory of the world free trade area from five aspects: legal concept, classification standard, legal characteristics, legal status and research significance. The second chapter analyzes the management system of Guangdong free trade test area, based on the macro management system and micro system of the free trade area, compared with the domestic and foreign free trade test area management model. The paper puts forward the target model of Guangdong Free Trade Test area and the difficulties to overcome. The third chapter analyzes the admission system of Hong Kong and Macao service trade in Guangdong Free Trade Test area, taking the legal barriers of CEPA service trade before and after access as a starting point, combining with the international and domestic legal rules of service trade. On the premise of straightening out the scope of legal authorization on trade in services, Guangdong free trade experimental area strives for more legislative authorization on the basis of existing authority, and puts forward breakthrough points and solutions to trade service system involving Hong Kong and Macao. The fourth chapter, based on the international customs law, analyzes the customs supervision system of Guangdong Free Trade Test area, and combines the present situation of the three regions in Guangdong Free Trade Test area. This paper analyzes the shortage and puts forward the scheme of customs supervision system with the characteristics of Guangdong Free Trade Test area.
