我国政府监管房地产市场的法律制度研究

【摘要】:近年来,中央政府颁布监管政策最为关注的产业便是房地产业,例如限贷、限购、提高房产税、二手商品房所得税等等,这些特有名称都是我们最为熟悉的。针对房地产的垄断竞争等特点,中央政府一直保持应当对其进行内部监管的态度。当前,相关的监管政策丰富多样,例如财税方面、土地买卖方面甚至针对购房者的,这些规定都是非常严格的。但是面对不断上涨的房价现象来看,各项政策并没有对房地产市场产生一个健康有序的环境,反而产生了一定的负面影响。甚至在面对上涨的房价来说,却需要购房者来承担此结果。笔者从房地产业的发展和监管出发,研究监管主体和对象来分析中央政府颁布的相关监管政策。在分析中央政府在房地产业应当行使的相关行政责任时,提出了完善建议,为规范房地产业提供一些理论依据。笔者从以下四部分对提出的完善建议进行论述:第一部分“房地产市场监管的基础理论”,对房地产市场监管的概念、监管主体以及监管的政策目标方面进行了介绍;第二部分“房地产市场发展与政府监管的现状分析”,就我国房地产市场发展的现状以及我国政府监管房地产市场的现状进行了介绍,并对我国政府监管房地产市场产生的各种现象和效果做出一个合理的评价;第三部分“政府监管房地产市场存在问题分析”,从政府、市场两个方面讨论了我国政府监管房地产市场存在的问题,并从四个角度对其存在问题的原因进行了分析;第四部分“完善政府监管房地产市场的法律制度建议”,从土地审批制度、土地产权分配制度、土地长效供应制度、经济适用房保障制度和房地产市场监管问责制度五个方面对政府监管房地产市场提出了个人粗浅的完善建议。
[Abstract]:In recent years, the industry that the central government promulgates the supervision policy most pays close attention to is the real estate industry, for example, limits the loan, limits the purchase, raises the real estate tax, the second-hand commodity housing income tax and so on, these special names are most familiar to us. In view of the monopoly and competition of real estate, the central government has always maintained the attitude of internal supervision. At present, there are a variety of regulatory policies, such as taxes, land sales and even for home buyers, these regulations are very strict. However, in the face of rising housing prices, the policies have not produced a healthy and orderly environment, but have a certain negative impact on the real estate market. Even in the face of rising house prices, it takes buyers to bear the consequences. Starting from the development and supervision of real estate industry, the author studies the subject and object of supervision to analyze the relevant regulatory policies promulgated by the central government. When analyzing the relevant administrative responsibility that the central government should exercise in the real estate industry, this paper puts forward some suggestions to perfect it and provides some theoretical basis for standardizing the real estate industry. The author discusses the suggestions from the following four parts: the first part, "the basic theory of real estate market supervision", introduces the concept of real estate market supervision, the main body of supervision and the policy objectives of supervision; The second part of the "Real Estate Market Development and Government Supervision of the status quo Analysis", the development of the real estate market in China and the current situation of government supervision of the real estate market are introduced. And make a reasonable evaluation of the phenomena and effects of the government supervision of the real estate market. The third part "the analysis of the problems existing in the government supervision of the real estate market", from the government, This paper discusses the problems existing in the supervision of the real estate market by the Chinese government from two aspects of the market, and analyzes the causes of the problems from four angles. The fourth part is the suggestion of perfecting the legal system for the government to supervise the real estate market. From five aspects of land examination and approval system, land property right distribution system, land long-term supply system, comfortable housing security system and the system of real estate market supervision and accountability system, the author puts forward some personal suggestions for the government to supervise the real estate market.
