双边市场条件下互联网产业相关市场的界定

【摘要】:随着互联网的发展,越来越多的企业采用双边市场进行运营,这种特殊的经营模式给以产业组织理论为经济学基础的反垄断分析带来全新分析视角的同时,也带来巨大挑战,适用单边市场的传统工具和新兴方法能否应用于双边市场将是个严重的问题。司法实践中不断出现的新的案例急需理论研究予以回应。本文导论部分先提出问题,然后阐述了选题背景和研究意义,对现有法律规定及研究成果进行了评述,阐明国内外研究现状与发展趋势。正文分为以下四个部分:第一章,双边市场的基本理论,简要介绍了双边市场的概念,分析双边市场交叉网络外部性、平台两端定价机制不同、用户锁定降低需求替代性分析的三个特点。第二章,相关市场界定的一般理论,介绍了相关市场的概念和相关市场界定是需要考虑的三个维度,相关市场界定常用的替代性分析方法和SSNIP测试。第三章,双边市场下互联网产业相关市场界定的困境。围绕互联网产业相关市场界定都能够是否需要考虑双边市场、相关地域市场和SSNIP测试在双边市场条件下失效的问题,从理论和实践角度归纳总结相关市场界定面临困境。第四章,双边市场条件下互联网产业相关市场界定的出路。围绕模糊相关市场界定、改进SSNIP测试、重视互联网相关地域市场、引入双边市场思路对双边市场下的互联网产业相关市场界定提出解决方法。
[Abstract]:With the development of the Internet, more and more enterprises operate in the bilateral market. This special business model brings a new perspective to the antitrust analysis based on the industrial organization theory, and at the same time, it also brings great challenges. Whether traditional tools and emerging approaches for unilateral markets can be applied to bilateral markets will be a serious question. The new cases in judicial practice need to be answered by theoretical research. In the introduction part of this paper, the author first puts forward the questions, then expounds the background and significance of the selected topic, comments on the existing legal provisions and research results, and clarifies the present research situation and development trend at home and abroad. The text is divided into the following four parts: the first chapter, the basic theory of bilateral market, briefly introduces the concept of bilateral market, analyzes the externality of the cross-network of bilateral market, and the pricing mechanism of the two sides of the platform is different. Three features of alternative analysis of user locking down requirements. In the second chapter, the general theory of relevant market definition is introduced. The concept of relevant market and the definition of relevant market are three dimensions that need to be considered. The alternative analysis method and SSNIP test are used to define the relevant market. The third chapter, the dilemma of the definition of Internet industry related market under the bilateral market. Focusing on whether the definition of the relevant market of Internet industry should consider the bilateral market, the related regional market and the SSNIP test failure under the condition of the bilateral market, this paper sums up the difficulties of the definition of the relevant market from the theoretical and practical angles. The fourth chapter, under the bilateral market condition, the Internet industry related market defines the outlet. Focusing on the definition of fuzzy correlation market, improving the SSNIP test, attaching importance to the Internet-related regional market, and introducing the bilateral market ideas, the paper proposes a solution to the definition of the Internet industry-related market under the bilateral market.
