出租汽车牌照的财产属性分析

【摘要】：出租汽车牌照作为出租汽车经营权的客体,一方面,与物权法上的财产或物同样具有客观实在性、稀缺性、特定性与可转让性等特征;另一方面,它又具有政府管制性、行政特许性与功能复合性等新的特征。针对出租汽车牌照这种财产,政府管制性与行政特许性在功能、性质、主体等方面存在明显差异。正确理解出租汽车牌照的财产属性,有助于强化出租汽车经营权的理论基础。
[Abstract]:As the object of the right to operate the taxi, the taxi license, on the one hand, has the characteristics of objective reality, scarcity, specificity and transferability as well as property or property in the property law. On the other hand, it has the new characteristics of government regulation, administrative concession and function compound. There are obvious differences between government regulation and administrative concession in function, nature and subject. The correct understanding of the property property of the taxi license is helpful to strengthen the theoretical basis of the management right of the taxi.
