反垄断法私人实施的源流与功能研究

【摘要】:英美法系法律经济学家将法律的实施界分为公共实施与私人实施两种方式。反垄断私人实施最早源于美国,《谢尔曼法》第7条之规定可被视为其源头。在美国成功经验的推动下,越来越多的国家建立了反垄断法私人实施制度。反垄断私人实施可以弥补公共实施的不足,有利于克服反垄断法的不确定性,它对受害人的直接补偿还可促进矫正正义的实现,同时私人主体广泛参与反垄断法实施还是竞争文化培养和发展的助推器。
[Abstract]:The legal economists of Anglo-American law system divide the law enforcement into public enforcement and private enforcement. Antitrust private enforcement originated in the United States, and section 7 of the Sherman Act can be regarded as its source. Driven by American successful experience, more and more countries have established private enforcement system of anti-monopoly law. Anti-monopoly private implementation can make up for the deficiency of public implementation and overcome the uncertainty of anti-monopoly law. Its direct compensation to the victims can also promote the realization of corrective justice. At the same time, private subjects participate in the implementation of anti-monopoly law is also the booster of the cultivation and development of competitive culture.
