网络刷单及其法律责任

【摘要】:以电商交易、餐饮外卖、出行应用和互联网系统为代表的网络刷单严重扰乱了正常的市场交易秩序,有必要对其进行法律分析。经营者的非理性博弈、平台的自利性纵容、消费者的搭便车心理都在一定程度上加剧了这一现象。刷单作为互联网领域的新型不法行为,通常应由反不正当竞争法、消费者权益保护法和互联网交易管理办法进行规制。要有效落实炒单刷信者的法律责任,应当在"软法"与"硬法"的二元结构中,在平台自律、行业调制与国家强制的三维视域下,依照社会规范和法律的有关规定,确凿落实行为人民事、刑事与行政等多个方面的责任。
[Abstract]:E-commerce, food takeout, travel application and Internet system have seriously disturbed the normal order of market transactions, it is necessary to carry out legal analysis. The irrational game of the operator, the self-indulgence of the platform and the free-rider psychology of the consumers all aggravate this phenomenon to a certain extent. As a new illegal act in the field of Internet, bill brushing should usually be regulated by anti-unfair competition law, consumer rights and interests protection law and Internet transaction management. In order to effectively carry out the legal responsibility of the fiduciary, we should, in the dualistic structure of "soft Law" and "hard Law" and under the three dimensional vision of platform self-discipline, industry modulation and state compulsion, in accordance with the social norms and the relevant provisions of the law, Concrete implementation of the actor's civil, criminal and administrative responsibilities in many aspects.
