网络虚假宣传法律规制研究

【摘要】:互联网科技的不断发展和普及带动了全世界范围内电子商务行业的迅速崛起。越来越多的经营者将精力投放于网络市场的开发和运用,试图利用互联网的优势最大限度的配合自身的商业竞争行为。与此同时,社会大众的交易习惯和生活方式也因此发生了巨大的变化,网络宣传逐渐成为影响消费者选择商品和服务的首要因素。一些不法经营者为了争夺有利的市场优势,排挤打压同行业竞争对手,有意识的利用网络科技从事虚假宣传等不正当竞争行为。相较于传统的虚假宣传行为,网络的虚拟性和开放性使其具有更强的危害性和更广泛的影响。它往往会给同业竞争者和消费者造成难以估量的损失,严重破坏了网络市场的良性竞争秩序。由于我国网络市场经济仍处于初步发展阶段,尚未形成成熟的网络立法体系,还没有对于网络虚假宣传行为进行规制的直接法律依据。实践中一般援引《反不正当竞争法》中的原则性规定对其进行界定和裁判,可操作性和适用性较差,加之各级立法机关的规定缺乏统一性和协调性,导致其在理解和运用上都比较混乱。而以政府强制规制为主导的规制模式和落后的监管手段也难以应对网络虚假宣传行为隐蔽性更强、损害范围更广的新特点,无法实现对其全面而准确的监管。不论是出于对网络市场良性竞争秩序的维护,还是对同业竞争者和消费者合法权益的保护,网络虚假宣传行为都理应成为检查监督部门的重点监管对象,亟需完善的立法体系和先进的监管手段予以有效的规制。本文从我国电子商务发展现状出发,以网络虚假宣传行为为切入点,对比美欧国家的反网络不正当竞争立法模式,剖析我国当前相关立法体系和规制手段的不足,对我国网络虚假宣传的规制进行系统的研究。在充分运用比较研究、实证研究等方法的基础上,提出一套针对网络虚假宣传行为的科学有效的规制体系,以促进我国电子商务的繁荣发展,为我国规制以网络虚假宣传为代表的网络不正当竞争行为尽绵薄之力。
[Abstract]:The continuous development and popularization of Internet technology has driven the rapid rise of e-commerce all over the world. More and more operators put their energy into the development and application of the network market and try to make use of the advantages of the Internet to maximize their business competition. At the same time, the trading habits and lifestyle of the public have changed greatly, and Internet propaganda has gradually become the primary factor affecting consumers' choice of goods and services. In order to compete for the advantageous market advantage, some illegal operators squeeze out and suppress their competitors in the same industry, and consciously use network technology to engage in unfair competition, such as false propaganda. Compared with the traditional false propaganda behavior, the virtual and open nature of the network makes it more harmful and more extensive. It often causes incalculable losses to competitors and consumers, and seriously damages the healthy competition order of the network market. Since our country's network market economy is still in the initial stage of development, it has not yet formed a mature network legislation system, and there is no direct legal basis for regulating the network false propaganda behavior. In practice, the principled provisions of the Anti-unfair Competition Law are generally invoked to define and adjudicate them, which are of poor maneuverability and applicability, coupled with the lack of uniformity and coordination of the provisions of the legislative organs at all levels. It leads to confusion in understanding and application. However, the regulatory model and backward regulatory means, which are dominated by government compulsory regulation, can not cope with the new characteristics of network false propaganda, such as stronger concealment and wider range of damage, and can not achieve comprehensive and accurate supervision. Whether it is to maintain the healthy competition order in the network market or to protect the legitimate rights and interests of competitors and consumers in the same industry, the false propaganda on the network should be the focus of supervision and control of the inspection and supervision department. It is urgent to improve the legislative system and the advanced regulatory means to effectively regulate. Based on the current situation of electronic commerce development in China, this paper contrasts the anti-network unfair competition legislation model of the United States and Europe, and analyzes the deficiency of the current relevant legislation system and regulation means of our country, taking the false propaganda behavior of the network as the starting point. This paper makes a systematic study on the regulation of false propaganda on the Internet in China. On the basis of comparative research and empirical research, a set of scientific and effective regulation system is put forward to promote the prosperity and development of electronic commerce in China.
