共享经济视野的网约车监管方式

【摘要】:共享经济具有业余性和临时性特征,通过互联网平台,将闲置资源分享给他人使用,既降低了交易成本,又提高了资源利用率,有效调整了社会资源配置。然而,地方政府出台的网约车实施细则,为网约车平台公司、车辆和驾驶员设置了较高标准,制约了网约车的发展,不仅违反了《行政许可法》的有关规定,更不符合共享经济的基本特征和发展规律。对共享经济进行法律规制,应当端正规制目的,重点在事中和事后与网约车平台公司开展合作,充分运用大数据收集和分析车辆行驶和乘客评价信息,实现对网约车安全和服务的全方位监管。
[Abstract]:Sharing economy has the characteristics of amateurism and temporary. Sharing idle resources to others through Internet platform can not only reduce transaction cost but also improve resource utilization and adjust social resource allocation effectively. However, the detailed rules for the implementation of net-chartering issued by local governments set a higher standard for net-ride-sharing platform companies, vehicles and drivers, which restricted the development of net-ride-hailing, and not only violated the relevant provisions of the "Administrative Licensing Law". Not in line with the basic characteristics of the shared economy and the law of development. To regulate the sharing economy, we should correct the purpose of the regulation, focus on cooperation with the ride-sharing platform company in the event and afterwards, and make full use of big data to collect and analyze the information of vehicle driving and passenger evaluation. To achieve a full range of security and service network car-sharing supervision.
