反垄断不能死抠法条

【摘要】：反垄断法不仅为了维护自由、公平的竞争,还要促进、提升市场经济的效率,因此对于垄断之利和反垄断中蕴涵的辩证法,必须明察。反垄断法是合理性与合法性高度统一、充分讲"理"的一种法。《反垄断法》及其条文,只是为判断一种行为是否合乎市场经济的要求提供一种分析的框架或方法,其有效实现高度依赖于整个社会形成恰当的市场经济理念;同时,还要善于在反垄断法的框架下作细致、周全的"经济学"分析。
[Abstract]:Anti-monopoly law is not only to safeguard freedom and fair competition, but also to promote and improve the efficiency of market economy. Therefore, the interests of monopoly and the dialectics contained in anti-monopoly must be clearly observed. Anti-monopoly law is a kind of law which is highly unified in rationality and legitimacy. The Anti-monopoly Law and its provisions provide an analytical framework or method for judging whether an act conforms to the requirements of market economy. Its effective realization highly depends on the whole society to form the proper market economy idea, at the same time, it should be good at making the detailed and thorough "economics" analysis under the frame of the anti-monopoly law.
