反垄断法上的经济学分析

【摘要】：反垄断法学是与经济学联系最为密切的法学部门。本文从反垄断实践的法学分析与经济学分析出发,首先在宏观层面上论述了经济学竞争理论,从完全竞争理论到哈佛学派的市场结构理论,再到芝加哥学派的行为效率理论,对反垄断法宗旨和目的的深切影响;进而从微观层面上,探讨了经济学对反垄断法学具体分析方法的介入,并结合我国3Q大战和锐邦诉强生案,对我国当前的反垄断实践进行了批判性思考。
[Abstract]:Antimonopoly law is the most closely related law department with economics. Starting from the legal and economic analysis of antitrust practice, this paper first discusses the theory of economic competition at the macro level, from the theory of complete competition to the theory of market structure of Harvard school, and then to the theory of behavioral efficiency of the school of Chicago. The paper discusses the intervention of economics in the specific analytical methods of antimonopoly law from the micro level, and combines the 3Q War and the case of Ruibang v. Johnson. This paper carries on the critical thinking to the current anti-monopoly practice of our country.
