跨境海事破产案件中船舶优先权法律问题研究

【摘要】:船舶优先权作为海商法的特有制度,体现的是海商法对特定主体的保护。船舶优先权是针对特定船舶享有优先受偿的权利。一般情况下,它的实现并不复杂;然而在跨境海事破产案件下,船舶优先权具有双重性质:破产债权和海事请求权。破产程序与海事程序的交叉,使它的实现过程变得复杂起来。这也是该篇论文的写作初衷。本文针对跨境海事破产案件中船舶优先权在实现过程中可能遇到的主要问题进行分析,并结合相关案件介绍其他国家的做法,旨在为我国协调破产程序与海事程序之际的冲突提供有价值的理论依据,为我国跨境海事破产制度的建立提出建议。本文分为引言、正文和结论三部分。正文部分分为四个章节展开论述:第一章明确了跨境海事破产案件的相关概念,并对跨境海事破产案件中船舶优先权的管辖权问题进行了论述。第二章阐述的重点是船舶优先权在跨境海事破产案件中受偿时可能遇到的法律适用问题,分为破产法与海商法的适用问题、破产程序中船舶优先权的法律性质及船舶优先权自身的法律适用三部分。第三章围绕着船舶优先权在跨境海事破产案件中遇到的程序问题,从破产保全对船舶优先权行使的影响和外国破产救济对船舶优先权行使的影响两个角度展开论述。第四章节对跨境海事破产案件中船舶优先权在我国现有破产法律和海事法律框架下的行使进行分析,并结合相关的司法实践提出建议,旨在弥补我国在跨境海事破产领域的缺失,实现海事特别程序与破产程序之间的衔接与协调,以缓和海事法院与破产受理法院在跨境海事破产案件上的种种冲突,顺应跨境海事破产领域的国际合作趋势,加强我国与国际社会在相关领域的互助与协作。
[Abstract]:Maritime lien, as a special system of maritime law, embodies the protection of specific subjects. Maritime lien is the right of priority payment to a particular ship. In general, its realization is not complicated; however, in cross-border maritime bankruptcy cases, maritime liens have a dual nature: bankruptcy claims and maritime claims. The intersection of bankruptcy procedure and maritime procedure makes its realization process complicated. This is also the original intention of the paper. This paper analyzes the main problems that maritime liens may encounter in the realization of cross-border maritime bankruptcy cases, and introduces the practices of other countries in the light of relevant cases. The purpose of this paper is to provide a valuable theoretical basis for the conflict between the bankruptcy procedure and the maritime procedure in China, and to put forward some suggestions for the establishment of the cross-border maritime bankruptcy system in China. This paper is divided into three parts: introduction, text and conclusion. The text is divided into four chapters: the first chapter clarifies the related concepts of cross-border maritime bankruptcy cases and discusses the jurisdiction of maritime liens in cross-border maritime bankruptcy cases. The second chapter focuses on the legal application of maritime liens in cross-border maritime bankruptcy cases, which can be divided into bankruptcy law and maritime law. There are three parts: the legal nature of maritime lien and the application of law of maritime lien itself. The third chapter focuses on the procedural problems of maritime liens in cross-border maritime bankruptcy cases from two aspects: the impact of bankruptcy preservation on the exercise of maritime liens and the impact of foreign bankruptcy remedies on the exercise of maritime liens. The fourth chapter analyzes the exercise of maritime liens in cross-border maritime bankruptcy cases under the existing bankruptcy law and maritime law framework in China, and puts forward some suggestions combined with the relevant judicial practice. The purpose of this paper is to make up for the deficiency in the field of cross-border maritime bankruptcy in China, to realize the connection and coordination between maritime special procedures and bankruptcy procedures, and to ease the conflicts between maritime courts and bankruptcy courts in cross-border maritime bankruptcy cases. In accordance with the trend of international cooperation in the field of cross-border maritime bankruptcy, we should strengthen the mutual assistance and cooperation between China and the international community in related fields.
