第三方物流中的物品安全法律制度研究

【摘要】：伴随信息网络的高度全球化以及社会分工日益细化,作为“第三利润源泉”的物流业已从原来单一的仓储、运输发展成为如今集仓储、包装、运输、配送、信息处理、售后为一体的产业链条。第三方物流是现代物流业发展的一种全新形态,其所提供的服务不仅包括物流活动的运作、组织、协调与管理,而且包含物流信息的集中处理以及来自第三方的监督等等。如今第三方物流仍处于初步发展的阶段,随着运作模式日趋多样化,其所涉及的法律关系也愈复杂,要排除制约我国第三方物流业发展的瓶颈,因此,建立起相应的第三方物流监管法律体系刻不容缓。以往文献大多从第三方物流市场准入制度和法律监管的角度来架构第三方物流存在的问题,本文以第三方物流中最重要的物品安全为切入点,主要从以下几个部分进行论述：第一部分主要介绍物流及第三方物流的基本概念,以及物品安全的定义和特性；第二部分分析我国第三方物流的物品安全存在的问题,首先从市场准入制度开始分析,其次从第三方物流市场运作中找出问题所在,最后针对目前我国第三方物流物品安全的救济措施的问题展开讨论；第三部分主要阐述目前发达国家第三方物流物品安全相关制度经验及借鉴；第四部分针对存在的问题提出相应的完善我国第三方物流物品安全法律制度的建议,从相关指导思想的建设入手,并提出构建相关法律制度的具体措施。
[Abstract]:With the highly globalization of the information network and the increasingly detailed social division of labor, the logistics industry, as a "third profit source", has developed from a single warehousing and transportation industry to a collection of warehousing, packaging, transportation, distribution, and information processing. After-sale as one of the industrial chain. Third party logistics (TPL) is a new form of modern logistics industry. Its services not only include the operation, organization, coordination and management of logistics activities, but also include the centralized processing of logistics information and supervision from third parties. Nowadays, the third party logistics is still in the initial stage of development. With the diversification of the operation mode, the legal relationship involved in the third party logistics is becoming more and more complicated. Therefore, the bottleneck restricting the development of the third party logistics industry in China should be eliminated. It is urgent to establish the corresponding third-party logistics supervision legal system. Most of the previous literatures have constructed the problems existing in TPL from the perspective of market access system and legal supervision of TPL. In this paper, the most important goods safety in TPL is taken as the starting point. The first part mainly introduces the basic concepts of logistics and third party logistics, as well as the definition and characteristics of goods safety; the second part analyzes the problems existing in goods safety of third party logistics in our country. First of all, from the market access system to analyze, then from the third party logistics market operation to find out where the problem, and finally to our country third party logistics goods safety relief measures to start to discuss; The third part mainly elaborates the relevant system experience and reference of the third party logistics goods safety in the developed countries at present; the fourth part puts forward the corresponding suggestions to perfect the third party logistics goods safety legal system of our country in view of the existing problems. Starting with the construction of relevant guiding ideology, this paper puts forward some concrete measures to construct the relevant legal system.
