我国B2C在线调解机制研究

【摘要】:随着二十一世纪网络的发展和计算机的普及,人们工作、学习、生活的方方面面已经步入了电子信息化时代。网络消费以其快捷、可选择范围广、性价比高取代了传统消费方式,成为了消费者购物首选。其中B2C市场交易规模在整体网络购物市场交易规模远高于其他网络消费模式。随着网络消费的发展,B2C市场将在网络购物行业中占据越发重要的地位。在B2C蓬勃发展给人们带来便利的同时也带来了诸多网络购物纠纷,数量庞大的网购纠纷如通过传统争议方式处理,耗时费日且无法得到及时有效的解决。本文通过介绍分析B2C在线调解机制的运行模式及特点,对现阶段我国B2C模式中存在的问题进行分析,结合国内外的实践发展经验,提出我国B2C在线调解机制的完善意见和建议。除引言和结语外,本文分为四个部分。第一部分主要是B2C在线调解机制概述。主要介绍了B2C法律纠纷的概念、主要类型及特殊性,明确现阶段B2C电商模式中的内外部在线调解机制模式。第二部分介绍我国B2C在线调解实践困境以及相关法律规范。通过对我国现阶段B2C平台内外部在线调解机制的现实应用情况和配套法律规范进行研究分析,总结出我国B2C纠纷中在线调解无法取得良好效果的原因及存在的实践和法律问题,从而提出规范B2C在线调解制度的必要性。第三部分对境外《英国通信法》、《联合国国际贸易法委员会国际商事调解示范法》、《美国仲裁协会商事调解规则》及境外在线调解机构运行模式进行研究分析,有针对性地整理总结B2C在线调解国外实践中成功经验及可借鉴之处。第四部分对如何完善我国B2C在线调解机制提出意见和建议。结合各国实践经验以及我国的B2C商业模式发展情况,具体从在线调解机构设置、在线调解员选任及监督、在线调解运作规则及在线调解协议的执行等几方面,提出完善我国现阶段B2C商业模式的在线调解机制对策。
[Abstract]:With the development of the network and the popularization of computers in the 21 century, all aspects of people's work, study and life have stepped into the era of electronic information. With its fast, wide range of choices and high performance-to-price ratio, internet consumption has become the first choice for consumers. The transaction scale of B2C market in the whole online shopping market is much higher than that of other online consumption modes. With the development of online consumption, B2C market will play an increasingly important role in the online shopping industry. B2C booming development brings convenience to people but also brings many online shopping disputes a large number of online shopping disputes such as through the traditional way of dispute processing time-consuming and can not be resolved in a timely and effective manner. By introducing and analyzing the operation mode and characteristics of B2C online mediation mechanism, this paper analyzes the problems existing in the B2C mediation mechanism in China at present, and puts forward some suggestions and suggestions for the perfection of B2C online mediation mechanism in our country in combination with the practical development experience at home and abroad. In addition to the introduction and conclusion, this article is divided into four parts. The first part is an overview of B-2 C online mediation mechanism. This paper mainly introduces the concept, main types and particularity of B2C legal disputes, and clarifies the internal and external online mediation mechanism mode in B2C e-commerce mode. The second part introduces B2C online mediation practice dilemma and related legal norms. Through the research and analysis of the actual application of the internal and external online mediation mechanism of B2C platform in our country and the relevant legal norms, the paper summarizes the reasons why online mediation can not achieve good results and the existing practice and legal problems in the B2C dispute in our country. The necessity of standardizing B 2 C online mediation system is put forward. In the third part, the author makes a research and analysis on the overseas British Communications Law, the UNCITRAL Model Law on International Commercial Conciliation, the rules of Commercial Conciliation of the American Arbitration Association and the operating mode of overseas online conciliation agencies. Summarize the successful experiences of B-2 C online mediation in foreign countries and draw lessons from them. The fourth part puts forward some suggestions on how to perfect the online mediation mechanism of B2C in China. Combined with the practical experience of various countries and the development of B2C business model in China, the paper concretely discusses the establishment of online mediation organization, the selection and supervision of online mediator, the operation rules of online mediation and the implementation of online mediation agreement, etc. This paper puts forward the countermeasures to perfect the online mediation mechanism of B2C business model in China at the present stage.
